2. The Ruedi Resen-oir shall be constructed and maintained on the
'Fryingpan Ri,'er above the town of Basalt with an .ctive capacity of
not less t.han 100,0110 acre-feet. In addition theret.o and in order to
offset ad\'eI'HB stream flow conditions on the Hoaring Fork River above
t.he town of Aspen which might occur as a result of the project en-
.larcrement of the Twin Lakes Reservoir, the Ashcroft Reservoir on
Ca~t.Ie Creek, or some reservoir in lieu thereof, shall be constructed
on the Roaring Fork drain.ge above Aspen to a capacity of ap-
proximately 5,000 acre-feet.: PI'01>ided, lww?ver, That. the Ashcr?ft
Reservoir shall be cOllstl'ucted only If the Secretary of t.he Intenor
,titer appropriate study shall determine that its benefits exceed the
costs.
All of such stOl'ed water shall be released under t.he conditions and
limitatiolls hereinafter set. forth.
3. The reimhursahle cost, of construct.ion of the Ruedi Reser\'oir shan
be .a. cha.rge agaillst tIle Frying-pan-Arkansas project to the extent of
$7,600,000. The remaining reimburs~lble c.ost. of construct.joIl of the
R.necii ann Ashe-roft. Reservoirs or sullstit.lltes therefor sha.ll he returned
as if they were participat.ing projects ullder t.he act of April 11, 1056
(70 Stat.. 105), and all net re\'enues derived from their operation shall
be pa.i.-l iulo Lhe Upper Colorauo Hiver Ba~iu fUlld as provided in sec-
tion 5 of sa.id act. The cost of perpetun.l operation a.nd maintena.nce
of the Ruedi Reservoir shaU be borne by users of project water and
users of water store!l in Ruedi Resen"oir in such proportion 3S ma.y be
determined by t.he Secret.a-ry of t.he Interior. The cost of perpetual
operation and maintenance of the Ashcroft Reservoir shall be borne
by use.rsof water from that reservoir.
4. The inclusion of the Ruedi Reservoir in t.he project shall not pre-
clude the const.ruction of a.ny other repL.'lcement or regulatory reser-
voir~ on the Colorado Ri\'er or its tributaries above Cameo gaging
statIOn.
5. The Rnedi Reservoir shall be c.ompleted and in operation before
any water is flil'erted to eastern Colorado by means of t.he project.
6. (a.) The replacement capacit,y of Ruedi Reservoir, and any reser-
voir constructed in addition thereto, is that portion of the tot"l reser-
voir ca.pacity required to permit project diversions at times when such
diyersions conld not otherwise be ma,de hecause of simultaneous de-
mands of senior diversions in westenl Colorado existing at the time
of the adoption of these operat.ing principles, and sh..ll be so operate.d
to accomplish this purpose. Water stored in such capacity shall be
rele~sed by the United States, upon t.he reqnest of the Colorado Sta.t.e
englneer1 t.o t.he ext.ent that water wonld ha.ve been available to said
decreed right.<o; except for st.rea.m depletion resulting from diversions
by this project to the Arkansas Valley.
(b) The regulatory capacity of Ruedi Reservoir, and any reser\'oir
constru("t.ed in addition thereto, is that portion of the 1.01..1 re.servoir
capacity not needed for replacement purposes. Water stored in such
category may be sold or leased by the United States to waters users in
Colorado for any pllrpose recognized by the la,ws of t.he United States:
Provided, That t.he sale of water for use outside the natural basin of
the Colorado Ri\'er can ordv be made with the conse.nt of the Colorado
River Water Conservation District. Cha.rges for the use of such water
shall be est.ablished by the Secreta,ry of the Interior by appropriate
