The reimhursahle cost, of construct.ion of the Ruedi Reser\'oir shan <br />be .a. cha.rge agaillst tIle Frying-pan-Arkansas project to the extent of <br />$7,600,000. The remaining reimburs~lble c.ost. of construct.joIl of the <br />R.necii ann Ashe-roft. Reservoirs or sullstit.lltes therefor sha.ll he returned <br />as if they were participat.ing projects ullder t.he act of April 11, 1056 <br />(70 Stat.. 105), and all net re\'enues derived from their operation shall <br />be pa.i.-l iulo Lhe Upper Colorauo Hiver Ba~iu fUlld as provided in sec- <br />tion 5 of sa.id act. The cost of perpetun.l operation a.nd maintena.nce <br />of the Ruedi Reservoir shaU be borne by users of project water and <br />users of water store!l in Ruedi Resen"oir in such proportion 3S ma.y be <br />determined by t.he Secret.a-ry of t.he Interior. The cost of perpetual <br />operation and maintenance of the Ashcroft Reservoir shall be borne <br />by use.rsof water from that reservoir. <br />4. The inclusion of the Ruedi Reservoir in t.he project shall not pre- <br />clude the const.ruction of a.ny other repL.'lcement or regulatory reser- <br />voir~ on the Colorado Ri\'er or its tributaries above Cameo gaging <br />statIOn. <br />5. The Rnedi Reservoir shall be c.ompleted and in operation before <br />any water is flil'erted to eastern Colorado by means of t.he project. <br />6. (a.) The replacement capacit,y of Ruedi Reservoir, and any reser- <br />voir constructed in addition thereto, is that portion of the tot"l reser- <br />voir ca.pacity required to permit project diversions at times when such <br />diyersions conld not otherwise be ma,de hecause of simultaneous de- <br />mands of senior diversions in westenl Colorado existing at the time <br />of the adoption of these operat.ing principles, and sh..ll be so operate.d <br />to accomplish this purpose. Water stored in such capacity shall be <br />rele~sed by the United States, upon t.he reqnest of the Colorado Sta.t.e <br />englneer1 t.o t.he ext.ent that water wonld ha.ve been available to said <br />decreed right.<o; except for st.rea.m depletion resulting from diversions <br />by this project to the Arkansas Valley. <br />(b) The regulatory capacity of Ruedi Reservoir, and any reser\'oir <br />constru("t.ed in addition thereto, is that portion of the 1.01..1 re.servoir <br />capacity not needed for replacement purposes. Water stored in such <br />category may be sold or leased by the United States to waters users in <br />Colorado for any pllrpose recognized by the la,ws of t.he United States: <br />Provided, That t.he sale of water for use outside the natural basin of <br />the Colorado Ri\'er can ordv be made with the conse.nt of the Colorado <br />River Water Conservation District.
