The <br />report of this study shall be attached as an appendix to <br />the exhibit S of any subsequent license application for <br />the project. <br /> <br />and reported that as a result of discussions between Applicant <br />and Interior, Interior would not insist on the inclusion of <br />the $50,000 figure. By letter dated March 7, 1972, Interior <br />confirmed that it has no objection to removal of that part of <br />the suggested condition which would have required the Applicant <br />to provide funds up to a total of $50,000 to the Bureau of <br />Sport Fisheries and Wildlife of the Department of the Interior <br />for the conduct of studies. <br /> <br />The Department of Agriculture, Forest Service, (Forest <br />Service) stated it had no objection to granting the permit <br />provided that conditions relating to: (1) cooperation and con- <br />sultation with the Regional Forester; (2) construction of ac- <br />cess roads; (3) the use of Crater Lake as a pumped storage fore- <br />bay; (4) conducting field surveys, exploratory and investigation <br />work, and all other operations so that there will be no surface <br />disturbance nor mechanized transportation in the Flat Tops Primi- <br />tive Area; and (5) a limitation of the Rio Blanco Reservoir to <br />elevation 9,280 feet were included in the permit. By letter dated <br />March 31, 1969, Applicant stated its preference that the specific <br />restriction on the elevation of the Rio Blanco Reservoir be de- <br />ferred. Applicant did not object to the other conditions set <br />forth by the Forest Service. <br /> <br />No construction i~ ~11'rh()l"";'7ed bv t-hp ic:::c:::nrln("'j:3 f"\f' ::. rrt=>- <br />liminarv permit. Such a permit gives the permittee, during <br />the permit, the right to priority of application for license <br />over other non-Federal entities, while the Permittee under- <br />takes the necessary studies and examinations required by the <br />Act and the Regulations under the Act in order to determine the <br />economic feasibility of the proposed project, the means to <br />securing the necessary financial arrangements for construction, <br />the market for the power, and all other information necessary <br />for inclusion in an application for license, should one be <br />applied for under the permit. In the event an application for <br />a license is filed, public notice of that filing will be given <br />and an opportunity will be provided for interested parties to <br />be heard on the application for license. <br /> <br />Expenditures made by a Permittee for studies and examina- <br />tions under a preliminary permit are entirely at the Permittee's <br />risk that the project may prove to be economically infeasible, <br /> <br />..f <br />; <br /> <br />II <br />
