In particular. <br />agencies shall be responsive to a request <br />by the Council for the pro::paration and <br />circulation of 2.n environmental state- <br />ment. wlless the :l.gency determines that <br />such a statement is not required, in. <br />which case the azency sh:l.ll prepare an <br />environmental a~sessment and a publicly <br />available record brie!ly seLtIng iorth the <br />reasons for its determination. In no case. <br />however, shall the Council's silence or <br />failure to comment or request pl'ep~.ra- <br />tion. modification, or recirculation of an <br />environmental statement or to take other <br />action with respect to an environmental <br />statement be construed as bearing in any <br />way on the Question of the legal reqUire- <br />ment for or the adequacy of such state- <br />ment under the Act. <br /> <br />~ 1500.12 J.e~i:;lalh'e uclions. <br /> <br />(a) The COWlcil and the Office of <br />Management and Budget will cooperate <br />in giving guidance as needed to assist <br />agencies in identifying legislati'.-e items <br />belieyed to have environmental signifi- <br />cance. Agencies should prepare impact <br />statements prior to submission of their <br />legislative proposals to the Office of Man- <br />agement and Budget. In this regard, <br />agencies should identify types of repe'ti- <br />tive legislation reqUiring em.ironmental <br />impact statements (such as certain types <br />of bill5 affecting transportation policy or <br />&.nnual cOllstrucUon authorizatlons). <br /> <br />. <br /> <br />(b) With respect to recommendations <br />or reports on proposals for lcgisl~tion <br />to v:hich section 1,J2(::!1 (Cl applies. th~ <br />final Lex!, ot t.he em'irollment:J15tatcment <br />and comments tl1ereon ~hould be avail- <br />ab!o:: to the Co::gress ~l1d to Lhe p:Jb;ic <br />for cO~lsideration in connection wiLh the <br />proposed legblation or report. The Council after examining E:n- <br />vironment:\! statements and agency pro- <br />cedures with respect to .3uch statements <br />will issue such supplements to these <br />guidelines as are necessary. <br />Ib) Agencies will continue to assess <br />the-ir experience in the implementation <br />of the section 102(2) (C) provisions of <br />the Act and in conforming v:ith these <br />guidelines and report thereon to the <br />Council by June 30, 1974. Such report.s <br />should include an identification of ~he <br />problem areas and suggestions for revi- <br />sion or clalification of these guidelines <br />to achiHe effecti\'e coordination of \'"iews <br />on em'ironmental aspects (and alten1a4 <br />tives, where appropriate) of proposed ac- <br />tions without imposing unproductive ad~ <br />ministrati\'e procedures.
