In Chapter 4, IRRIGATION IMPROVEMENTS, one of the al- <br />ternatives contemplates improvements in irrigation <br />efficiency that would make water available for use on <br />land having a water right, but which historically has <br />not been irrigated on a consistent basis because of <br />available water supply. The issue is: can a water <br />user improve his efficiency and thus consumptively use <br />more water than he historically has under the water <br />right? The State Engineer has stated that the situa- <br />tion has not been resolved by the courts, and thus his <br />authori ty is not clear: however, it is his opinion <br />that the potential impact on downstream water users <br />who have historically relied upon return flow to sat- <br />isfy all or a portion of their water right cannot be <br />ignored (Dee Hansen, 1982). <br /> <br />2. In Chapter 4, one of the alternatives involves reduc- <br />ing leakage from canals running stockwater in the win- <br />ter. Winter seepage contributes to the groundwater, <br />which furnishes a portion of the crop consumptive use <br />requirements during the growing season. The issue is: <br />does the summer user have a right to that water? <br /> <br />3. In Chapters 5, 6, and 7, using drainwater for various <br />purposes, it has been assumed that drainwater rights <br />could be filed for and approved for salinity control <br />purposes as long as they did not adversely impact <br />downstream water users in the Price and San Rafael <br />River Basins.
