<br />B. Establishment of An Escrow Account <br /> <br />In any year in which the sum of Metropolitan's share of <br />California I s basic 4.4 maf apportionment, and the quantity of <br />unused Lower Division states' apportionments, and surplus water <br />would not permit Metropolitan to divert up to 1.3 maf, Metropolitan <br />agrees to place into an escrow account operated by the seven <br />Colorado River Basin states, monies for each acre-foot of Colorado <br />River mainstream water that it uses in excess of the said sum, <br />consistent with the provisions of IV A. Monies in the escrow <br />account will be apportioned to each state to offset any impacts <br />associated with this use of water by Metropolitan. Therefore, such <br />apportioned monies will be available to fund water conservation <br />measures that result in more efficient use of developed water <br />supplies, measures to enhance environmental protection, <br />recreational opportunities, firm water supplies for existing <br />storage in the interstate water bank, and other purposes that each <br />state desires to enhance the public welfare. <br /> <br />Operation of the escrow account is depicted on Figure 3. The <br />distribution of monies within the escrow account has been assumed <br />to be based on two equal factors: 1) apportioned use of water and <br />2) risk of water shortages or other impacts. It is further assumed <br />that the perceived risk of shortages or other impacts occur equally <br />between the Upper Division states and the Lower Division states. <br />Based on these assumptions, the prorata share of monies distributed <br />to each of the states is as follows: <br /> <br />Pro rata Share <br />(Percent) <br /> <br />Arizona <br />California <br />Colorado <br />Nevada <br />New Mexico <br />Utah <br />Wyoming <br /> <br />26.4 <br />15.2 <br />18.1 <br />8.8 <br />9.9 <br />13.3 <br />8.3 <br /> <br />100.0 <br /> <br />The derivation of the above percentages is included in Appendix A <br />and an example of how the escrow account might operate in 1994 is <br />included in Appendix B. <br /> <br />C.
