B. Establishment of An Escrow Account

In any year in which the sum of Metropolitan's share of
California I s basic 4.4 maf apportionment, and the quantity of
unused Lower Division states' apportionments, and surplus water
would not permit Metropolitan to divert up to 1.3 maf, Metropolitan
agrees to place into an escrow account operated by the seven
Colorado River Basin states, monies for each acre-foot of Colorado
River mainstream water that it uses in excess of the said sum,
consistent with the provisions of IV A. Monies in the escrow
account will be apportioned to each state to offset any impacts
associated with this use of water by Metropolitan. Therefore, such
apportioned monies will be available to fund water conservation
measures that result in more efficient use of developed water
supplies, measures to enhance environmental protection,
recreational opportunities, firm water supplies for existing
storage in the interstate water bank, and other purposes that each
state desires to enhance the public welfare.

Operation of the escrow account is depicted on Figure 3. The
distribution of monies within the escrow account has been assumed
to be based on two equal factors: 1) apportioned use of water and
2) risk of water shortages or other impacts. It is further assumed
that the perceived risk of shortages or other impacts occur equally
between the Upper Division states and the Lower Division states.
Based on these assumptions, the prorata share of monies distributed
to each of the states is as follows:

Pro rata Share
(Percent)

Arizona
California
Colorado
Nevada
New Mexico
Utah
Wyoming

26.4
15.2
18.1
8.8
9.9
13.3
8.3

100.0

The derivation of the above percentages is included in Appendix A
and an example of how the escrow account might operate in 1994 is
included in Appendix B.

C. Establishment of An Interstate Water Bank

An Interstate Water Bank, operated by a forum created by the
seven Colorado River Basin states, will be established to help each
of the seven Basin states meet its individual and their collective
water supply needs duri,ng critical, unique, or emergency water
supply periods. The operation of the interstate Water Bank is

15
