<br />o <br />r" <br />l-" <br /> <br />;:..1 <br />o <br /> <br />Arkansas River Compact <br /> <br />., <br /> <br />The Arkansas River Compact entered into by the states of Colorado <br />and Kansas was ratified by the legislatures of both states and approved <br />by the Congress of the United States in 1949. The stated purpose of the <br />compact is to settle disputes and remove causes of future controversy be- <br />tween citizens of the t....o states concerning the control, conservation and <br />utilization of the waters of the Arkansas River and to equitably divide <br />and apportion between the t....o states the waters of the Arkansas River as <br />well as the benefits arising from the construction, operation and main- <br />tell6DCe of the John Martin Reservoir. <br /> <br />. <br /> <br />The compact provides for an "Administration" consisting of' three <br />members from each state ....ho are appointed by the respective governors <br />and a representative of the United States ....ho is appointed by the Presi- <br />dent and ....ho is an ex-of'f'ido member and acts as chairman of' the adminis- <br />tration without vote. The administration is given paver to adopt, amend <br />and revoke by-la....s, rules and regulations; to prescribe procedures f'or <br />administration of' the compact; and to perform all functions required to <br />implement the compact and to do all things necessary, proper or convenient <br />in the performance of' its duties. <br /> <br />.. <br /> <br />A basis is provided f'or apportionment of' the waters of' the Arkansas <br />River, both the river flov into the John Martin Reservoir and releases <br />of' water stored in the reservoir. Provision is made f'or gaging stations <br />to measure releases of water to the respective states. <br /> <br />. <br /> <br />Pollution Control and Abatement <br /> <br />Kansas has detailed and ef'f'ective water pollution control statutes. <br />Administrative authority and responsibility for water pollution control <br />is vested in the State Board of' Health. The principal administrative <br />responsibility falls upon the Engineer ....ho is appointed by the Board of' <br />Health and pollution control activities are carried out by the Division <br />of' Sanitation of' ....hich the Engineer is Director. There is no specific <br />statutory authority f'or development of' a comprehensive program in the <br />f'ield of' water 1?01lution; nevertheless substantial progress has been <br />made in abatement and prevention of' pollution. Statutory def'iciencies <br />lie principally in the field of' municipal 'f'inancing of pollution abate- <br />ment ....orks and maintenance and operation of' such ....orks.
