<br />I\:) <br />CD <br />c.;:l <br />0) <br /> <br />COMPLIANCE WITH FEDERAL ACQUISITION REGULATION (FAR): <br />DRUG-FREE WORKPLACE ACT OF 1988 <br /> <br />The Federal Acquisition Regulation (FAR) revisions included <br />in this interim rule implement the Drug-Free Workplace Act <br />of 1988 (Pub lie Law 100-690) and are app I i cab I e to a II <br />federal agencies. Under.the regulation, all offerors on <br />contrac ts expected to equa lor exceed $25,000 wi I I be <br />required to certify that they wi I I maintain a drug-free <br />workplace by compl iance with the following: <br /> <br />1. Publishing a statement notifying employees that drug <br />abuse in the workp I ace is proh i b i ted. <br /> <br />2. Establishing a drug-free awareness program to inform <br />its employees of the dangers of drug abuse, the <br />contractor's drug-free workplace policy, the <br />availability of drug counseling programs and the <br />possible penalties for convictions for drug abuse <br />violations occurring in the workplace. <br /> <br />3. Requiring each employee directly involved in the <br />performance of a government contract to notify the <br />employer of any criminal drug statute conviction <br />occurring In the workplace, and requiring the <br />contractor to so notify the government. <br /> <br />4. Requiring the imposition of sanctions or remedial <br />measures for an employee convicted of drug abuse <br />violations in the workplace. <br /> <br />5. Requiring the contractor to continue, in good faith, <br />ongoing compl iance with the above requirements. <br /> <br />With respect to contractors consisting of only one <br />individual, regardless of dollar value, the regulation <br />requires the individual to certify that he/she ",ill not <br />engage in un I awfu I conduct re I ated to contro II ed substances <br />in the workplace. Development or promulgation of a drug- <br />free awareness program i 5 not requ j red for contractors <br />consisting of only one individual. The agencies intend that <br />a "principal investigator-II in a research or simi lar contract <br />be viewed as an individual, only if the contract is awarded <br />directly to the investigator. <br />
