<br />1980 Operating Plan for John Martin Reservoir as it relates to the transit <br />loss account for Kansas. Mr. McDonald stated that this matter did not <br />need to be resolved at this meeting. A long discussion ensued, with no <br />specific decisions being reached. It was agreed to take up the matter <br />again at a special meeting in March. <br />Mr. Cooley stated that the next item of discussion would be a request <br />for an engineering report from the Keesee Ditch on its proposed transfer <br />of wafcr rights from District 67 to abo\'e John Martin Reservoir. said <br />report to be submitted to the Administration. Mr. Pope stated that <br />Kansas was in agreement with the draft letter proposed by Colorado. Mr. <br />McDonald then moved that the Administration direct the chairman to <br />send the letter. Mr. Pope seconded the motion and added that a copy <br />should go to the Water Court and all the parties to the litigation. Mr. <br />McDonald said he concurred. The motion was unanimously adopted. The <br />letter was subsequently sent by the Vice-Chairman (due to Mr. Cooley's <br />illness) and is included as Attachment K. <br />The next item on the agenda was the proposed storage account for the <br />Las Animas.Bent County Golf Course, Inc., in John Martin Reservoir. <br />Mr. McDonald briefly outlined the history of the Las Animas Golf Course <br />account. He stated that the Administration, through the Operations <br />Committee, had made arrangements for a temporary account for the <br />past summer for 175 aJ. in John Martin Reservoir, the source of water <br />being the purchase of transmountain water. The "Decision of the <br />Operations Committee" with respect to this matter is included as <br />Attachment L. The purpose of the account was to permit the golf course to <br />pump sewage effluent from the Town of Las Animas' wastewater <br />treatment plant up to a new golf course for lawn irrigation purposes and <br />then replace those out-oC-priority diversions using the water in the <br />account. <br />After a brief discussion on whether the golf course should have a <br />permanent account in John Martin Reservoir, Mr. McDonald moved that <br />the Administration grant a continuation of the temporary account with <br />the existing water therein through October 31, t985, with the temporary <br />account to cease as of that date and any water remaining in the account <br />after that date to go into conservation storage. Mr. Genova seconded the <br />motion, which was subsequently passed unanimously. <br />The next item on the agenda was a status report on the proposed <br />permanent winter storage program. Mr. McDonald stated that Kansas <br />had requested that this item be on the agenda and that he had asked that <br />Mr. Kevin Pratt, attorney for the Southeast Colorado Water Conservancy <br />District, to make the presentationMr. Pratt stated that an application for <br />the winter storage program had not yet been filed, but that there had been <br />meetings all summer and fall with interested parties in the hopes of <br />putting together a proposed decree and an application. He indicated that <br />it was hoped that an application would be filed by the end of the year. <br />Mr. Pope asked a series of questions regarding the priority of the <br />proposed decree, the nature of the agreement being discussed by the <br />parties, and what information would be necessary to support such a filing <br />in terms of engineering reports and data to substantiate the effect of the <br />proposed decree on the river. Mr. Pratt responded that Colorado statutes <br />require that copies of the decrees for tte involved ditches and diversion <br />records for the last 10 years be submitted to the courts.
