Holders of unpatented mlnlnq claims validly established on any <br />National Forest Wilderness prior to inclusion of such unit in <br />the National Wilderness Preservation System shall be accorded <br />the riqhts provided by the United States mininq laws as then <br />applicable to the National Forest land involved. Persons locating <br />mininq claims in any unit of National Forest Wilderness on or <br />after the date on which the said unit l'las included in the tlational <br />Wilderness Preservation System shall be accorded the rights pro- <br />vided ~y the United States mininq laws as anplicable to the <br />National Forest land involved and subject to provisions specified <br />in the establishinn lenislation. All claimants sball comrly <br />with reasonable conditions nrescribed by the Chief, Forest <br />Service, for the nrotection of r~ational Forest resources in <br />accordance with the "eneral purposes of maintaining the National <br />Wilderness Preservation Svstem unimpaired for future use and <br />enjoyment as wilderness and so as to nrovide for the preserva- <br />tion of its wilderness character; and a performance bond may <br />be required. <br /> <br />J <br /> <br />(1) Prior to commencinq oneration or develool7ient of any mininf] <br />claim, or to cuttinq timber thereon, mininQ claimants shall <br />file written notice in the office of the Forest Sunervisor <br />or District Ranner havina jurisdiction over the land involved. <br />Unless within 20 days after such notice is Qiven the Forest <br />Service requires the claimant to furnish operatinq plans <br />or to accent a pe~lit noverning such operations, he may <br />commence operation, development, or timher cutting. <br /> <br />(2) No c1aimant shall construct roads across r!ational Forest <br />Wilderness unless authorized by the Forest Service. Appli- <br />cation to construct a road to a mininn claim shall be filed <br />\1ith the Forest Service and shall be accomranied by a rlat <br />sho~tin('l the location of the proposed road and by a descrip- <br />tion of the type and standard of the road. The Chief, Forest <br />Service, shall, when arrrorriate, authorize construction <br />of the road as nronosed or shall require such channes in <br />location and tvpe and standard of construction as are neces- <br />sary to safeGuard the National Forest resources, includinq <br />wilderness values, consistent with the u!€ of the land for <br />mineral location, exploration, develornJent, drillinq, and <br />production and for transmission lines, waterlines, telerhone <br />lines, and nrocessinq operations, includinq, where essential, <br />the use of mechanical transport, aircraft or motorized equip- <br />ment. <br /> <br />(3) Claif11ants shall cut timber on mining claims ~Iithin I!ational <br />Forest Wilderness onlv for the actual development of the <br />clai", or uses reasonahlv incident thereto. rmv severance <br />or removal of timber, other than severance or removal to <br />
