<br />replaced or modified in the future as uncertainties with respect to flow recommendations <br />and development of Colorado's compact apportionment are resolved. <br /> <br />The range of options to accomplish this are: <br /> <br />1) Appropriate nothing now because of uncertainties with the actual flows needed <br />for recovery of the fish; <br />2) Appropriate the full flows recommended by the Fish and Wildlife Service <br />(FWS), regardless of uncertainty; <br />3) Appropriate water rights that "sunset" at a future date unless deliberately <br />extended by the Board; <br />4) Appropriate water rights that will continue, unless and until modified by Board <br />action; <br />5) Appropriate water rights that include two components; a component not <br />expected to be modified and an explicitly modifiable water right. Modification <br />of the water rights would be based on scientific/biological information provided <br />by the FWS and/or information developed by the Board with respect to <br />development of Colorado's compact apportionments. Modifications would be <br />made pursuant to previously agreed upon procedures; <br />6) Reserve a specific amount of water for future development of Colorado's <br />compact apportionment and appropriate the remainder of the available flow for <br />recovery purposes. A "development allowance" may be apportioned on a basin- <br />by-basin basis in a manner determined by the Board in consultation with the <br />water user community and interested parties. The total development allowance <br />of all basins would approximate Colorado's remaining undeveloped compact <br />apportionment. <br />7) Appropriate water rights for less than the amounts recommended by the FWS, <br />with the expectation that additional amounts would be appropriated in the <br />future as scientific data supporting the recommendations is developed and as <br />Colorado's compact apportionment is developed and more defined. <br /> <br />4 <br />
