If a plan for <br />augmentation is not obtained in the Water Court by the expiration date, an annual renewal of <br />this plan is required. Any request for renewal of this plan must be submitted with the statutory <br />fee of $217 at least 45 days prior to the date of expiration. Should this substitute water supply <br />pian expire without renewal or be revoked prior to adjudication of a permanent plan for <br />augmentation, all operations at the gravel pit must cease immediately. <br /> <br />9. This substitute water supply plan may be revoked or modified at any time should it be <br />determined that injury to other water rights has or will occur as a result of this plan. <br /> <br />10. Acceptance of these conditions must be made in writing to this office, the Division Engineer <br />(310 E. Abriendo Ave., Suite B, Pueblo, CO 81004), and the Water Commissioner (Dan <br />Neuhold, 30240 County Road 12, lamar, CO 81052) within two weeks of your receipt of this <br />letter. The name, address, and phone number of a contact person who will be responsible <br />for the operation and accounting of this plan must be provided with the acceptance. <br /> <br />This office does not condone the eradication of native wetland vegetation. likewise, <br />approval of this plan does not satisfy any federal laws or regLilations or liability resulting therefrom. <br />Please contact Keith Vander Horst of this office or Steve Witte, Division Engineer, in Pueblo at <br />(719) 542-3368 if you have any questions concerning this approval. <br /> <br />Sincerely, <br /> <br />/~tJ.
