As ofthis time, Stockman's has not filed an application to secure the water <br />rig hts for the project. <br /> <br />',1 <br /> <br />Litigation Involving Closed Basin Division <br /> <br />On August 28, 1998, Cabeza De Vaca Land and Cattle Company, Inc., filed a civil <br />action in United States District Court for the District of Colorado (Civil Action File No. <br />98-B-1868) against Secretary of the Interior Bruce Babbitt, et.a!., alleging that the <br />operation of the Project has caused damage to their property. <br /> <br />The authorizing legislation for the Project is the Reclamation Project Authorization Act <br />of October 20, 1972 (P.L. 92-514). Section 102 of the Act states that the Secretary <br />shall operate project facilities in a manner that will not cause the water table available <br />for any irrigation or domestic wells in existence outside the project boundary prior to the <br />construction of the project to drop more than 2 feet and in a manner that will not cause <br />a reduction of,artesian flows in existence prior to the construction of the project. <br /> <br />&: <br />,!- <br /> <br />~i <br /> <br />The United States, the Colorado Water Conservation Board, and the Rio Grande Water <br />Conservation District do not believe the Project has been operated in violation of <br />Section 102.
