<br /> <br />C-;;?1 ","O'~'_ <br />~. ~.' ~;-..;~. <br />'({: ,~; ~~ <br />district. 11 a petition for the purchase of water is filed by <br />a city or town, thereafter the assessment upon the resi- <br />dents of the community to pay for such water is imposed <br />as part of his general town or city taxes, The farmer who <br />petitions for an allotment of water agrees that he will <br />pay his annual charges and the lien for that assessment <br />becomes a general obligation on his property, Thus the <br />formation of a conservancy district makes possible the <br />purchase of water but does not require it. However, since <br />water cannot be sold outside the boundaries of the dis- <br />trict, any area that may ultimately desire to participate <br />in the project benefits shoUld be in the district from its <br />inception. <br />From a practical standpoint the problems posed by <br />the requirements of the formation of a water conservancy <br />district will require the active support of the enlightened <br />citizenry of theefitireArkansas Valley. People from Lead- <br />ville to the state line will .be called upon to render help. <br />There are many problems which..,pose themselves in the <br />..creation of any such form of legaf entity. However, it is <br />.i .~."';.'believed that a conservancy district is the most flexible <br />. ... and desirable form of entity. Its constitutionality has been <br />upheld repeatedly in the Colorado Supreme Court and <br />over the years its powers and duties have been, clarified <br />far more than is true of any other form of entity that <br />might be conceived. <br />In order to accomplish all of this preparatory work <br />it will require considerable sums of money to pay the <br />expenses of circulating petitions, doing the necessary <br />engineering work and legal work for outlining the <br />boundaries of the district, Where individuals cannot give <br />their time to such a development they could help tre- <br />mendously by their donations to the Water Development <br />Assn. of Southeastern COlorado which has been the vol- <br />untary non-profit organization that has carried the battle <br />for the Fryingpan project over the past several years. <br /> <br />N <br />W <br />o <br />0) <br />
