<br />o <br /> <br />The Preferred Alternative ultimately selected and implemented by the Secretary of <br />the Interior must recognize and comply with the Law of the River. <br /> <br />o <br /> <br />The Preferred Alternative must not impair delivery obligations by the Upper Basin <br />at Lee Ferry and annual and monthly deliveries scheduled pursuant to the Annual <br />Operating plans developed under the Colorado River Basin Project Act and the Long <br />Range Operating criteria. <br /> <br />o <br /> <br />Annual delivery obligations must comply with the criteria for Coordinated Long <br />Range Operation of Colorado River Reservoirs and the minimum object release of <br />8.23 maf must be maintained. <br /> <br />o <br /> <br />Flood frequency reduction measures requiring the reservation of additional storage <br />space in Lake Powell should not impair the storage of water required to meet long <br />term delivery obligations to the Lower Basin. Additional flood control space should <br />be achieved by increasing the capacity of Lake Powell by raising the spillway gates <br />as proposed in the Preferred Alternative. <br /> <br />o <br /> <br />Beach/Habitat building flows of 45,000 cfs exceed the power plant capacity of 33,200 <br />cfs, violate the Law of the River and cannot be supported by Colorado. <br /> <br />o <br /> <br />The preferred alternative must adequately address the economic and financial <br />impacts of any criteria and operating plans adopted pursuant to the Grand Canyon <br />Protection Act, including: <br />impacts on energy users, <br />economic and environmental impacts of the replacement of lost energy <br />and power generating capacity, <br />. integrity of the Upper Colorado River Basin Fund, and <br />reallocation of the costs of construction, operation, maintenance and. <br />emergency expenditures. <br /> <br />Thank you again for giving Colorado the opportunity to provide these comments at this <br />time.
