Paragraphs 1 through 3 of the Construc- <br />tion Agreement narrate the background, objective and <br />benefits of the Salinity Control Program for GVIC. In <br />essence, Reclamation is seeking to line or place <br />in pipe approximately 103 miles of unlined ditches <br />and thereby reduce salt loading to the Colorado <br />River by an estimated 24,700 tons per year. <br /> <br />. Particioatinl! Laterals Participating laterals are <br />defined in both the Construction Agreement and the 0 <br />& M Agreement to mean incorporated lateral ditch <br />companies, receiving their water from one of the three <br />approved increments of GVIC, with power to assess <br />their members for the participating lateral's share of 0 <br />& M costs and which have been approved for accep- <br />tance into the Salinity Control Program. <br /> <br />. Aooroach. <br />1. Construction is planned to commence Sep- <br />tember I, 1991 or as soon as GVIC shareholders <br />approve GVIC's participation in the Salinity Con- <br />trol Program. GVlC will perform the construction <br />with technical assistance and oversight from Rec. <br />lamation. The participating laterals are respon- <br />sible to obtain and make available to GVlC all <br />necessary easements and rights-of-way for con- <br />struction,O & M, and rehabilitation and replace- <br />ment of salinity improvements. Title to easements <br />and rights-of-way as well as salinity improvements <br />remain with the participating lateral. Seasoning <br />and testing is expected to take six months. All <br />costs of design, construction, seasoning and <br /> <br />co <br />~ <br />~ <br />N <br />c <br />o <br /> <br />testing and deficiency corrections will be <br />funded by Reclamation. <br /> <br />2. Reclamation will provide technical assis- <br />tance and oversight for construction of salinity im- <br />provements, including providing designs and tech- <br />nical specifications, review of surveys and rights- <br />of-way, construction, supervision, quality control <br />and funding. <br /> <br />3. GVlC will obtain all necessary construction <br />permits and provide all necessary construction ex- <br />pertise' labor, equipment and materials. GVIC will <br />also assist Reclamation with design, developing <br />schedules for work programs, and accounting <br />reports. GVIC will assist participating laterals in <br />organizational efforts to obtain necessary legal <br />power to participate in the program and, if deter, <br />mined eligible, reimburse such participatinglater- <br />als up to $1,500 for organizaiional costs. GVIC will <br />also have the authority to reimburse participating <br />laterals up to $2,000 for legal fees and costs for <br />eminent domain proceedings undertaken by par- <br />ticipating laterals to acquire necessary easements, <br />Property damage caused by construction will be <br />paid by Reclamation. <br /> <br />. Construction Schedule. Construction will not in- <br />terfere with irrigation. During the irrigaiion season, <br />efforts will be directed towards organization of par tic i- <br />pating laterals, obtaining easements and designing <br />improvements for the next construction season. <br /> <br />. General. <br /> <br />III. SUMMARY OF OPERATION AND MAINTENANCE AGREEMENT <br /> <br />The 0 & M Agreement is intended to address the 0 <br />& M of salinity improvements once they have been sea- <br />soned, tested, and deficiencies corrected and accepted <br />by Reclamation. The 0 & I\l Agreement, to some <br />extent, overlaps with the Construction ~"Teement and <br />in some instances addresses in greater detail matters <br />pertainingto eligibility of participating laterals, inclu- <br />sion of deferred increments, replacement of improve- <br />ments and acceptance of existing impro\'ements. <br /> <br />. Imoortant Definitions. <br /> <br />1. Particioatinf'" Laterals. Participating later- <br />als are defined in both the Construction Agree- <br />ment and the 0 & M Agreement. The 0 & M <br />Agreement limits participating laterals to those <br />who receive water from the Keifer Extension Canal, <br />Grand Valley Highline Canal and the Mainline <br />Canal east of the split, (7th and Horizon Drivel <br />including the Mesa County Ditch. The Independ- <br /> <br />ent Ranchman's Ditch and the GVIC Mainline <br />Canal west of ihe split are the deferred incre- <br />ments. <br /> <br />2. GVIC Staf'"e II Facilities. GVIC Stage !I <br />Facilities refers to improvements constructed with <br />funds provided by Reclamation, and also includes <br />any participating lateral's ditches and distribution <br />system already in existence which are accepted by <br />Reclamation. <br /> <br />3. Base Cost. Base cost is defined to be the <br />normal annualcosi for the 0 & I\l ofa participating <br />lateral's ditches and distribution facilities prior to <br />the construction of the salinity improvements. <br /> <br />4. Reolacement. Replacement is the major <br />modification and reconstruction of any of the salin- <br />ity improvements because of design or construc- <br />tion inadequacies or expiration of the normal, <br />useful life. <br /> <br />3 <br />
