<br />4. BUREAU OPERATION OF HERON
<br />RESERVOIR: The Bureau of Reclama-
<br />tion stores only imported San juan.

<br />voir and releases it in accordance
<br />with requests from those who have
<br />contracted for its delivery. Water
<br />levels in the reservoir have generally
<br />been maintained at or near the
<br />400,000 af capacity since filling in
<br />1983. The Bureau is authorized to
<br />divert an average of 110,000 aflyr (not
<br />to exceed 135,000 af in anyone year)
<br />in order to replenish reservoir storage
<br />and to meet project requirements.
<br />
<br />The Bureau contracts provide that
<br />users must accept delivery of their
<br />water by December 31 of each year,
<br />Users are not entitled to carryover
<br />storage in Heron Reservoir; they
<br />therefore lose their right to water that
<br />is undelivered by the end of the year,
<br />even though they must still pay for it.
<br />This provision led to the situation
<br />where large flows from Heron were
<br />released in December, as buyers
<br />scrambled to find downstream stor-
<br />age space or a use for their water, and
<br />called for the water prior to the year
<br />end deadline.
<br />
<br />These extremely high December
<br />flows, followed by no SjC releases in
<br />the winter months when the natural
<br />Rio Chama flow is quite low, were
<br />frustrating to the U.S. Fish and Wild.
<br />life Service and others who wanted to
<br />see thriving fishe.ies on the Chama.
<br />Negotiations commenced and the
<br />Bureau, with the concurrence of SJC
<br />contractors, has on a year by year
<br />basis extended the December deliv-
<br />ery deadline into March and April to
<br />permit Heron releases for fish
<br />enhancement during the low flow
<br />winter months.
<br />
<br />The State of New Mexico, through its
<br />Interstate Stream Commission (ISC)
<br />and the State Engineer, is involved in
<br />the delivery of SjC water. The ISC
<br />acts as an intermediary between the
<br />Bureau and many of those who have
<br />contracted for SJC water, informing
<br />the Bureau when deliveries are
<br />
