<br />THE UNITED STATES
<br />AND THE
<br />STATE OF COLORADO

<br />THIS COST SHARING AGREEMENT is made this --1M.h day of ,June ,1989,
<br />pursuant to the Act of June 17, 1902 (32 Stat. 388), and acts amenoatory thereof
<br />or supplementary thereto, all commonly known and referred to as the Federal
<br />Reclamatlon Laws, between the UNITED STATES OF AMERICA, hereinafter referred to
<br />as tne United States, acting through the Regional Director, Uoper Colorado
<br />Reglon, Bureau of Reclamation, the duly authorized representative of the
<br />Secretary of tne Interior, ano the STATE OF COLORADO, for the use and benefit of
<br />the ColoraOo Deoartment of ~atural Resources (Colorado Water Conservation
<br />Board), nereinatter referreo to as tne State.

<br />35 WHER~AS, the Secretary of the Interior has been authorized by Public
<br />36 Law ~~-5~4 (~6 Stat. 964), as amendeD by Public Law 96-375 (94 Stat. 1505),
<br />37 Public Law 98-~70 (98 Stat. 2941), and Public Law 100-516 (102 Stat. 2566),
<br />3d hereinaiter collectively referred to as the authorizing legislation, to
<br />39 construct tne Closed Basin Division, hereinafter referreo to as tne Project, San
<br />40 Luis Valley Project; and

<br />42 WHEREAS, the Project, whi ch consists of Stages 1-2, 3, 4, and 5, is
<br />43 currenti; under construction; and
