The eriteria used to identify the <br />purpose of new obligatioll$ are left unspecified. In cons.id- <br />ering requesls for transferr., the Regional Director will eon- <br />s.ider, among other factors, "applicable Departmental, Recla. <br />malion.. or othcr Federal regulations. policies, or guidelines in <br />effect al the time of revicw." Presumably, applicable policies <br />and guidelines include the Interior's 1988 principles and Rec- <br />lamation's 1989 Criteria and Guidance." Yet, none of the key <br />points in Ibesc documenls are exprcssly incorporatcd into the <br />proposed regulations (e.g. third party effects arc identified as <br />those tbat affect entities who may bave an identifiable interest <br />in Ihe tran~-S 'l'SOI would have legal sLanding in an adjudi- <br /> <br />cation process in an appropriate !.tale (arum; terms negotiated <br />by the parties do nol concern Interior). In effect.. <br />the bureau proposes to reintroduce a "use it or lose it" doctrine <br />back into western water decisions. <br />Second, a Iramfer mU51. mitigate or compensate for third <br />party effects to the satisfacl.ion of the Regional Director "and <br />impacted third parries:' Absent is the principle included in the <br />"1989 Criteria and Guidance" that third parties are identified <br />by thcir legal !.tanding in an appropriate state forum. More- <br />over, Ibird parties interests must be satisfied under tbe pro- <br />posed regulations. nol $imply considered as is common under <br />state law. Once again.. tbe proposed regulations are silent on <br />the criteria the Regional Director will use in reaching a deci- <br />SIOD. <br />Ezr;Jumgts and TmtponIIY Si2la. The proposed regula. <br />tions uses the !.aD\e approach for exchanges and temporary <br />sales (Iransad.ions not exceeding one year). If so, this requlrement <br />\IlIill reduce the economic returns agricultural water users may <br />earn from exchangcs and temporary sales. <br /> <br />. <br /> <br />. <br /> <br />WHEELING NONPROJEt.iWATER <br /> <br />The proposed regulations specify fifteen conditions that <br />must be satlsfied before the Regional Director will approve the <br />wbeeling of non project waler through tbe lower Colorado <br />River (see Box 5). <br />Among the conditions: (a) water to be wheeled mu.sl. not. <br />otherwise reaeh (Of have reached) tbe mainslream of the <br />Colorado River; (b) the waler must be of equal or greater <br />quality than Ihat of the mainstream at tbe point nonprojed. <br />water would reach the mainstream; (e) the applicanl musL show <br />lhat the wheeling would nol injure other parties; (d) Ihe party <br />requesting tbe wheeling has no claim on the return flow <br />generated by the use of nonprojeet water; (e) the nonprojed <br />water would be subject to conditions of accumulation. reten- <br />tion, release and ....ithdrawaJ as prescribed by the Secretary of <br />Interior, and share in Colorado River I<x>sc-s at the same rate <br />established for Colorado River water l05Ses; and (f) the appli- <br />canl .....ill receive no credit for energy generalion as a result of <br />the wheeled water passing through hydroelectric power gen. <br />eration facilities. <br />Nonproject water will bave a junior priority of us.e for <br />Colorado River storage and dcli'..ery system.
