Water stored by contracting entities must be legally and physically available under <br />decrees held by the contracting entities; and, storage in enlarged space is subject to the <br />limitations as established by the authorizing legislation and master storage contract with <br />Reclamation. <br /> <br />Allotment contract holders may store water that is intended for re-sale within Colorado. <br />Allotment contract holders may sub-lease their storage space to other water users within the <br />District. However, when the allotment contract holders are not fully utilizing their storage <br />space, the Enterprise will have the first option to store water on an If & When basis. This <br />water, stored by the Enterprise, will be subject to spill if and when the allotment-contract <br />holders need the space for their use, and when no other enlarged space is available for such <br />temporary storage. <br /> <br />The District will hold a right to store native water in the enlarged space under a 2000 <br />appropriation date, when that right is in priority and only when space is available. A portion <br />of the enlarged space will be designated as Enterprise Water Management Storage (uses for <br />the EWMS are described in Section 4 of this Implementation Committee Report). When <br />EWMS is not being used for Enterprise purposes it will be available for use by allotment <br />contract holders on an If & When basis, subject to an appropriate charge for the O&M costs <br />associated with EWMS. <br /> <br />3.9 Limitations and Obligations <br /> <br />The following limitations and obligations will apply to all entities that agree to secure an <br />allotment contract in the proposed enlarged storage capacity in Pueblo Reservoir and <br />Turquoise Reservoir: <br /> <br />1. . Enterprise Water Management Space - Each participant in the enlargement project will <br />be obligated to fund the development of an additional 15 percent of storage space over- <br />and-above their individual storage needs. Such storage space will be designated as <br />Enterprise Water Management Storage and used as described in the EWMS Section of <br />the Implementation Committee Report. <br /> <br />2. Re-operations Contract - Participating entities that are eligible to use re-operations space <br />must be making payment under contract with Reclamation for the use of such space. <br />Payments under the existing long-term If and When storage contract held by Board of <br />Water Works of Pueblo meet this obligation. <br /> <br />3. Flow Management Program - Firm-storage allotment contract holders, like re-operations <br />contract holders, agree to participate in a cooperative flow management program <br />designed to achieve a 100 cfs target minimum flow on the Arkansas River immediately <br />below Pueblo Dam. <br /> <br />11 <br /> <br />99061 Final PSOP Kepon <br />
