<br />APPENDIX "C" <br /> <br />* * * . <br /> <br />Rules and Regulations of <br />ARKANSAS RIVER COMPACT ADMINISTRATION <br />Effective April 15, 1950 <br /> <br />< <br />, <br /> <br />r <br /> <br />I <br /> <br />Explanatory Statement <br /> <br />The Arkansas River Compact is herein referred to as the "Com' <br />pilet," and the Arkansas River Com pact Administration is herein re' <br />tcrred to as the "Administration". <br />Under the Compact, authority and responsibilities for the opera' <br />tion and maintenance of John Martin Dam and Reservoir, for the re' <br />lease of water therefrom, for the intcf!:tatc operation of the Arkansas <br />River brt\\'cen Colorado and Kansas and for the intrastate distribution <br />uf water of that river, arc divided among tht'sl? Federal and State <br />(\g,,-'I1CIl~:', vi::: tIlt' Curps of Engineers, Un{tcd SW.te's Army, the Ad- <br />Illinistr~ltion and the Chief Official in each of the States of Colorauo <br />and K,msfl.s chttrged \l"lith the admini!:tration of water rights. <br />Th,~ <tuthnrity and rcspon~ihiliti(:s of each of these agencies and <br />officials arc recognized to be as follows: <br /> <br />Corps of Engineers, United States Army <br /> <br />1. The Corps of Engineers is authoriz.ed to operate and maintain <br />the John Martin Dam and Reservoir for flood control and conserva- <br />tion purposes: Provided, that the conservation pool in such project shall <br />be orerated in a manner conforming with the Arkansas River Compact. <br />2. Under the provisions of the Compact, the maintenance of John <br />Martin Dam and appurtenant works may at times require the Corps <br />of Engineers to release water then impounded in the conservation pool, <br />or to prohibit the storage of water therein, until such n1i1intenance work <br />15 completed and that flood control operations may also involve tem- <br />porary utiliz.ation of conservation storage. <br /> <br />The Arkansas River Compact Administration <br /> <br />1. The conservation pool in John Martin Reservoir will be oper- <br />ated for the benefit of water users in Colorado and Kansas, both up- <br />stream and downstream from John Martin Dam, as provided in the <br />Com pact. <br />2. The administration has the authority and responsibility to ef~ <br />(ectuate the apportionment of water between the States of Colorado <br />and Kansas in the manner provided by, and in accordance with, the <br />Arkansas River Compact, including these provisions: <br />(a) Article V A, B, C, D and E of the Compact rdating to the <br />releases, and reduction in releases, of water from storage in <br />the conservation pool of John Martin Reservoir and of river <br /> <br />.." <br /> <br />~ <br />I <br /> <br />19 <br />
