The twelve rranber states of the Council particularly <br />appreciate the staterrent by the Task Force that the agreerrents must be <br />tailored to the circumstances of the individual states. <br /> <br />15. The pro;x>sal for a standing inter-agency ccmmittee <br />appears to be a v.Drthwhile suggestion as the anticipated coordination <br />would seen to b: helpful aIrOIl9' federal agencies. The states \'iOUld <br />welcorre an oppo.:'tunity for a central point fran which to discuss the <br />state-federal relationships and the anticipated agreanents. <br /> <br />16. The Western States \-later Council l:elieves that if an <br />appropriate set of reccmren:J.ations are forwarded to the President that <br />can be based on a reasonable legal starding by federal attorneys, that <br />the mechanism of formalizing the Administration's policy executive order <br />would be useful,as the Task Force has concluded. <br /> <br />As previously stated, however, the Nestern States Water Council <br />feels that further consideration should be given to going beyond an <br />executive order, ard in certain areas, seeking legislation to clarify <br />. --- , issues, including the establishnent of federal reserved rights in <br />the future. If the Task Fora: reccmrendations are to flow out of the <br />Interior Deparbnent's Solicitor's opinion and alleges net, federal water <br />rights such as the non-reserved \,ater rights doctrine expoused, the <br />Council will be opposed to any formalization of the Task Force recan- <br />mendations. <br /> <br />Further, the western states see little value in the Task Force <br />report unless all federal participants are to be round by the decisions <br />made. The vies tern States Water Council has sensed a a:rtain aloofness <br />in the Justice Dept. with respect to the entire exercise. If the <br />Justice Dept. is not a full partner in the decisions rendered by the <br />Task Force, and does not feel round by adminstrative or executive orders, <br />the entire water policy effort in this subject area will be of little <br />value. <br /> <br />-14- <br /> <br />I <br />i <br />.1 <br />, <br /> <br />.f' <br />
