<br />11 <br /> <br />Diligence Requirements: <br /> <br />A detailed development plan must be submitted by each successful bidder <br />prior to the third anniversary of the lease. If an acceptable plan is <br />not submitted the lease may be cancelled after the issuance of two notices <br />for an unacceptable plan. The lessee will be allowed one year to comply <br />with each notice. The plan must require diligent development. <br /> <br />Environmental Baseline Data: <br /> <br />Environmental baseline data pertaining to the quantity and quality of <br />surface water, ground water, the quality of the air and the population <br />relationships of flora and fauna will be collected for at least one <br />year prior to the submission of a detailed development plan and for one <br />additional year prior to commercial operations. <br /> <br />Environmental Monitoring: <br /> <br />The lessee will be required to submit to the lessor the results of <br />environmental monitoring for public release on an annual basis. <br /> <br />Public Hearings: <br /> <br />The Mining Supervisor will conduct public hearings on the environmental <br />aspects of the detailed development plan. . He will be assisted by the <br />Oil Shale Technical Advisory Board which will be composed of members .' <br />from Interior and other Federal agencies with observers from State and <br />local governments. <br /> <br />Mitigation: <br /> <br />The detailed development plan must conform to all Federal, State and <br />local air, water and land regulations and standards, and would include <br />a fish and wildlife management 'plan,and must have approval by the <br />Mining Supervisor before development is started. The lessee is <br />responsible for the rehabilitation of all disturbed areas. He must pro- <br />tect areas having historic or scientific values, and the' development plan <br />must provide contingency planS for oil spills. The Department will require <br />a revegetation research program, unless the lessee can prove that he has <br />the technology available to fulfill the requirements of the program. <br /> <br />~: <br /> <br />, <br /> <br />The lessee must post a liability bond in the amount of $20,000 which <br />will stand against all actions. For the first three years of the lease <br />the lessee will post an environmental bond in the amount 'of $2,000 per <br />acre for mine and disposal areas and in the amount of $500 per acre for <br />all other lands affected by his operations under the lease. Upon approval <br />of the detailed development plan, the Department will require a bond to <br />cover the reclamation and restoration of all acreage to be affected <br />during the.ensuing three-year period. This bond will be reviewed upon <br />a change in development plans or every three years and maY be changed at <br />that time to cover anticipated costs for reclamation. <br /> <br />0<31. <br />
