An appropriate written contract may be made whereby Twin Lakes <br />Reservoir & Canal Co. shall refrain from diverting water whenever the natural <br />flow of the Roaring Fork River and its tributaries shall be only sufficient to <br />maintain a flow equal to or less than that required to maintain the recommended <br />average flows in the Roaring Fork River immediately above its confluence with <br />Difficult Creek in a quantity proportionate to the respective natural flow of the <br />Roaring Fork River. The recommended average flows above mentioned are flows <br />in quantities equal to those recommended as a minimum immediately above its <br />confluence with Difficult Creek according to the * following schedule submitted <br />by the United States Fish and Wildlife Service and the Colorado Game and Fish <br />Commis sion: <br /> <br /> Average Acre-feet <br />Month second-feet (thousands) <br />October 44 2.7 <br />November 35 2.1 <br />December 29 1.8 <br />January 26 1.6 <br />February 25 1.4 <br />March 24 1.5 <br />April 64 3.8 <br />May 100 6.2 <br />June 120 7.1 <br />July 100 6.2 <br />August 63 3.9 <br />September 44 2.6 <br />Total 40.9 <br /> <br />In maintaining the above averages, at no time shall the flow be re- <br />duced below 15 c.f. s. during the months of August to April, inclusive or <br />below 60 c.f. s. during the months of May to July, inclusive, providing the <br />natural flow during said period is not less than these amounts. The obligation <br />to supply the minimum streamflow as set forth in the above table on the Roaring <br />Fork River shall, to the extent of 3,000 acre-feet annually, be a project obli- <br />gation to be supplied from any waters diverted from the south tributaries of <br />Hunter Creek, Lime Creek, Last Chance Creek, or any of them. <br /> <br />The Twin Lakes Reservoir & Canal Co. shall not be required to <br />refrain from diverting water under its existing decrees from the Roaring Fork <br />River except to the extent that a like quantity of replacement water is <br />furnished to said company without charge therefor through and by means of <br />proj ect diversions and storage. <br /> <br />* Page 4 of House Document 130. <br /> <br />-391- <br />
