RES 0 L U ! ION

WHEREAS, Public Law 92-514, as amended by Public Law 96-375,
authorizes the Secretary of the Interior, hereinafter referred to
as the "Secretary," to construct, operate, and maintain the
Closed Basin Division, San Luis Valley Project, Colorado, herein-
after referred to as the "project"; and

WHEREAS, Section 101(b) of said public law provides thqt
"Construction of the project may be undertaken in such units or
stages as in the determination of the Secretary will best SerVe
project requirements and meet water needs: Provided, That con-
struction of each of the succ,essive units or stages' after Stage I
of said project shall be ~ndertaken only with the consent of the
Colorado Water Conservation Board and the Rio Grande Water Con-
servation District ...."; and

WHEREAS, the Secretary, acting through the Bureau of
Reclamation, desires to initiate the preparation of designs and
specifications for the conveyance channel and laterals in' Stage 3
of the project in federal fiscal year 1984 in order that con-
struction on these features can be initiated in May, 1985.

NOW, THEREFORE, BE IT RESOLVED by the Colorado Water
Conservation Board in regular session assembled at DenVer,
Colorado, the 3rd day of November, 1983, that t,he. Board, does
hereby consent to the preparation of designs, and specifications
and to the construction of the conveyance channel and laterals in
Stage 3 so long as: (1) the project proceeds in substantial con~
formity with the Definite Plan Report for said project, (2) the
U. S. Bureau of Reclamation proceeds with diligence in the con-
struction of Stages 1-2 and 3 of the project, and (3) construc-
tion of such conveyance channel and laterals is in compliance
with applicable state law; and

BE IT FURTHER RESOLVED that the Colorado Water Conservation
Board is not, by this action, giving its consent to the U.S.
Bureau of Reclamation to start construction on any features of
Stages 4 and 5 of the project, except those features necessary
for pre-construction activities, such as testing and preparation
of design data, or to start production pumping of Stage 3 wells;
and
