ION <br /> <br />WHEREAS, Public Law 92-514, as amended by Public Law 96-375, <br />authorizes the Secretary of the Interior, hereinafter referred to <br />as the "Secretary," to construct, operate, and maintain the <br />Closed Basin Division, San Luis Valley Project, Colorado, herein- <br />after referred to as the "project"; and <br /> <br />WHEREAS, Section 101(b) of said public law provides thqt <br />"Construction of the project may be undertaken in such units or <br />stages as in the determination of the Secretary will best SerVe <br />project requirements and meet water needs: Provided, That con- <br />struction of each of the succ,essive units or stages' after Stage I <br />of said project shall be ~ndertaken only with the consent of the <br />Colorado Water Conservation Board and the Rio Grande Water Con- <br />servation District ...."; and <br /> <br />WHEREAS, the Secretary, acting through the Bureau of <br />Reclamation, desires to initiate the preparation of designs and <br />specifications for the conveyance channel and laterals in' Stage 3 <br />of the project in federal fiscal year 1984 in order that con- <br />struction on these features can be initiated in May, 1985. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water <br />Conservation Board in regular session assembled at DenVer, <br />Colorado, the 3rd day of November, 1983, that t,he. Board, does <br />hereby consent to the preparation of designs, and specifications <br />and to the construction of the conveyance channel and laterals in <br />Stage 3 so long as: (1) the project proceeds in substantial con~ <br />formity with the Definite Plan Report for said project, (2) the <br />U. S. Bureau of Reclamation proceeds with diligence in the con- <br />struction of Stages 1-2 and 3 of the project, and (3) construc- <br />tion of such conveyance channel and laterals is in compliance <br />with applicable state law; and <br /> <br />BE IT FURTHER RESOLVED that the Colorado Water Conservation <br />Board is not, by this action, giving its consent to the U.S. <br />Bureau of Reclamation to start construction on any features of <br />Stages 4 and 5 of the project, except those features necessary <br />for pre-construction activities, such as testing and preparation <br />of design data, or to start production pumping of Stage 3 wells; <br />and <br /> <br />702 <br />San/Luis <br /> <br /> <br />- <br />
