<br />{,' q'I <br /> <br />2-17 <br /> <br /> <br />The statute authorizes that some amounts of oil produced from these <br />fields be transferred to the Strategic Petroleum Reserve although most of <br />the production is to be sold to the highest bidder. Naval Reserve oil has <br />been exempt from domestic price regulation. Monies derived from the sale <br />of this oil will remain in a Navy fund and, subject to Congressional author- <br />izations, can be used to develop the Strategic Petroleum Reserve and the <br />Alaskan NPR-4 which is estimated to contain up to 30 billion barrels of <br />50 <br />crude petroleum. <br /> <br />2.2.10 Petroleum Marketing Practices Act (PMPA) <br />The PMPA, signed into law on June 19, 1978, prohibits termination or <br />non-renewal of franchise agreements between motor-fuel distributors and <br />franchised independent dealers. 51 While PMPA does not freeze supplier- <br />purchaser relationships, its purpose is to correct petroleum industry <br />practices which discriminate against certain marketing elements gaining <br />competitive advantages. <br />PMPA requires that changes in historical supplier-purchaser agreements <br />within the petroleum industry be accomplished in a prescribed climate of <br />equality.52 Additionally, PMPA requires the testing, certification, and <br />posting of gasoline octane ratings at retail outlets, and calls for a study of <br />the extent to which refiners and wholesalers subsidize gasoline marketing <br />with profits from other segments of their operations. 52 <br /> <br />2.2.11 Powerplant and Industrial Fuel Use Act of 1978 (FUA) <br />Enacted as one of five separate statutes known collectively as the <br />National Energy Act, FUA prohibits the use of oil in new power plants and <br />major fuel burning installations. 53 Additionally, it allows for prohibiting the <br />use of oil in existing power plants which are capable of using coal or other <br />alternate fuels, except natural gas, as a primary energy source.
