<br />, . <br /> <br />SECTION 1.0 <br />INTRODUCTION AND SUMMARY <br /> <br />This report presents the results of an investigation of Federal and <br />state statutes and regulatory programs which are considered to be influen- <br />tial in the historical development and the present and future status of US <br />energy markets. The overall objective of this energy regulatory analysis <br />is to identify Federal and state policies, legislation, and their resultant <br />programs significantly affecting the production and allocation of energy <br />resources in the High Plains region. <br />The following paragraphs describe the relation of this regulatory <br />analysis to the rest of the energy study elements and provide brief over- <br />views of Federal and state energy regulation. The subsequent sections of <br />this report contain detailed documentation of the various laws and regula- <br />tory programs. <br /> <br />1.1 PURPOSE OF ENERGY REGULATORY ANALYSIS <br />In formulating the work plan for the Six-State High Plains - Ogallala <br />Aquifer Area Study, the High Plains Council recognized the importance of <br />Federal and state regulation on the price and availability of energy com- <br />modities. The study plan specified that "the effects of Federal and State <br />energy regulations on the availability and cost of energy" be assessed as <br />part of the regional energy impacts analysis. * <br />This activity was formulated in the Interim Report of the High Plains <br />Associates as Regional Study Element B-8. 7, Survey Regulatory Environment <br />in the Region. The purpose of this task was stated as follows. <br />. "To identify, evaluate, and summarize the influences of any <br />applicable laws and statutes on the cost and availability of energy <br />in the region.
