<br />
<br />1. BONDS
<br />
<br />a, Bid guarantee.-The bidder shall furnish
<br />guarantee V'Jith each bid in an amount not less than
<br />20 percent of the amount of the bid: Provided, That
<br />guarantee in excess of $3,000,000 will not be
<br />required. (See Standard Form 22, Instructions to
<br />Bidders.)
<br />
<br />b. The contractor shall furnish bonds as follows:
<br />
<br />(1) Performance bond with approved su rety. or
<br />sureties, and with a penal amount equal to 100
<br />percent of the contract price at the time of
<br />award.
<br />
<br />(2) Payment bond.-If the amount of the
<br />contract exceeds $2,000, the contractor shall
<br />furnish to the United States, in addition to the
<br />bond required under b.ll) hereof, a payment
<br />bond with a surety or sureties satisfactory to the
<br />officer awarding the contract, {Ot" the pt"Otection
<br />of all persons supplying labor and material in the
<br />prosecution of the work provided for in the
<br />contract, for the use of each such person.
<br />Whene-.Jel' the tota\ amount pavab\e by the terms
<br />of the contract shall be not more than
<br />$1,000,000, the payment bond shall be in the
<br />sum of one-half of the total amount payable by
<br />the terms of the contract. Whenever the total
<br />amount payable by the terms of the contract
<br />shall be more than $1,000,000 and not more
<br />than $5,000,000, the payment bond shall be in
<br />the sum of 40 percent of the total amount
<br />payable by the terms of the contract. Whenever
<br />the total amount payable by the terms of the
<br />contract shall be mOle than $5,Q()(},Q()(}, the
<br />payment bond shall be in the sum of $2,500,000.
<br />
<br />c. Requirements for execution of surety
<br />bonds.- Each su rety company bond (bid,
<br />performance, payment), which purports to have
<br />been executed by an agent or attorney.in-fact for
<br />the corporate surety. is required to have submitted
<br />with it a power of attorney to the signatory agent or
<br />attorney-in-fact, and executed by the corporate
<br />surety upon a date reasonably proximate to the date
<br />of the bond, or the power of attorney shall be
<br />accompanied by a certification of the surety to the
<br />effect that the power of attorney was in fu II force
<br />and effect upon a date reasonably prox imate to the
<br />date of the bond.

<br />2.
<br />
<br />The Government will provide the right-of.way or the
<br />site for permanent works or installations, the site for
<br />borrow pits, channels. spoil banks, and ditches, and
<br />right.of-way for accesS thereto over routes established
<br />by the contracting officer. The contractor will be
<br />permitted to use such land for construction purposes,
<br />but any additional right-of-way or land desired by the
<br />contractor for construction purposes shall be provided
<br />by the contractor without expense to the Government.
<br />
<br />3. CLEANING UP
<br />
<br />Upon completion of the work the contractor shall
<br />remove from the vicinity of the work all plant,
<br />buildings, rubbish, unused materials, concrete forms
<br />and other like material, belonging to him or used under
<br />his direction during construction. All work areas shall
<br />be graded and left in a neat manner conforming to the
<br />natural appearance of the landscape and as provided
<br />elsewhere in these specifications. In the event of the
<br />contractor's failure to do so the same may be
<br />~rfofmed by the Government, at the expense of the
<br />contractor, and his surety or sureties shall be liable
<br />therefor.
<br />
<br />'I. PROTESTS
<br />
<br />If the contractor disagrees with any direction,
<br />instruction, interpretation, or determination of the
<br />contracting officer, his authorized representative or the
<br />inspectors, he shall immediately upon the making of
<br />such direction, instruction, interpretation or
<br />determination, ask, in writing, ior written instructions
<br />from the authorized representative. After the filing of
<br />his written protest he shall proceed without delay to
<br />perform the work in accordance with the direction,
<br />instruction, interpretation or determination. In
<br />addition, he shall fully comply with the written notice
<br />provisions of the General Provisions clause entitled
<br />"Changes." Directions, instructions, interpretations or
<br />determinations of the contracting officer or his
<br />authorized representative contained in letters
<br />transmitting drawings to the contractor shall be
<br />considered as being subiect to protest as herein
<br />provided.
<br />
<br />5. FEDERAL, STATE, AND LOCAL TAXES
<br />
<br />a. Except as may be otherwise provided in this
<br />contract, the contract price includes all appJ icable
<br />Federal, State, and local taxes and duties. ,.
