The bidder hereby waives that portion of any alleged mistake or mis- <br />. takes in his bid which falls within the following amounts: <br /> <br />a. If original bid is $250,000 or less - 5% of the original bid; <br /> <br />b. If original bid is more than $250,000 and less than $500,000 - <br />$12,500 plus 4% of the original bid over $250,000; <br /> <br />c. If original bid is $500,000 or more, and less than $1,000,000 - <br />$22,500 plus 3% of the original bid over $500,000; <br /> <br />d. If original bid is $1,000,000 or more - $37,500 plus 2% of the <br />original bid over $1, 000, 000. <br /> <br />. <br /> <br />In cases where the allegation of mistake exceeds the applicable waived <br />amount and the request for correction is allowed, the amount waived <br />will be excluded and deducted from the contract price; however, the <br />amount waived as provided herein will not be deducted for the purpose <br />of evaluating bids to determine the low bidder. Such deduction for the <br />amount waived will be made as a lump sum deduction from the first <br />progress payment, or such succeedi.ng payments as may be necessary, <br />after 50 percent of the work has been completed. <br /> <br />The above waiver does not apply to any clerical mistake which is obvi- <br />0us or apparent on the face of the bid including but not limited to (1) a <br />mistake in the extension of a unit price or prices; (2) a mistake in total- <br />ing the sums of various bid items; or (3) obviously misplaced decimal <br />point. <br /> <br />The above provisions shall not be applicable to allegations of mistakes <br />which, if allowed, would result in a reduction in the bid price. <br /> <br />. <br /> <br />2. Allegations of mistakes in bids result in delays to the Government <br />in processing and making timely award of contract, thus delaying the <br />ultimate completion of the work. For the purpose of these bidding con- <br />ditions, thirty (30) calendar days after the date of opening of bids shall <br />be considered as the Government's normal processing time for making <br />award of contract. The bidder further agrees that the period allowed <br />for completion of the work, or any part thereof for which a separate <br />completion period is stated, shall be reduced by one (1) calendar day <br />for each calendar day in excess of thirty (30) calendar days from the <br />date of bid opening resulting from the bidder's allegation of mistake, <br />or mistakes, in the bid: Provided, That in no case will such reduction <br />for excess time exceed 10 percent of completion period stated for the <br />work or any part thereof for which a separate completion period is <br />stated. <br /> <br />. <br /> <br />GPO 841-oe9 <br />
