Impacts to listed species as a result of the <br />proposed oil shale developments have been addressed in five individual <br />biological opinions: (1) Clear Creek Shale Oil Project and GCC Joint Venture <br />Water System Terrestrial Bioloyica1 Opinion (FWS file number 6-5-83-0016, <br />finalized March 7, 1984); (2) Getty Oil Company and Cities Service Oil and Gas <br />Corporation Oil Shale Projects Terrestrial Biological Opinion (FWS file number <br />6-5-84-0002, finalized February 13,1984); (3) Aquatic Biological Opinion for <br />Listed Colorado River Fishes - GCC Joint Venture Water System; Clear Creek <br />Shale Oil Project and Associated Water System; Getty Shale Oil Project and <br />Associated Water System; and Cities Service Shale Oil Project and Associated <br />Water System (FWS file number 6-5-84-0003, finalized August 24, 1984); <br />(4) Union Oil Company Parachute Creek Oil Shale Program Phase II Expansion <br />Biological Opinion (FWS file number 6-5-83-0002, finalized January 30,1985); <br />and (5) Biological Opinion for Pacific Shale Project (FWS file number 6-5-84- <br />F-006, finalized February 27, 1985). <br /> <br />Some of the water being requested for purchase in the Ruedi Reservoir Round II <br />sale may be used by projects for which impacts have a1 ready been analyzed in <br />the above referenced consultations; less than 60 percent of the currently <br />identified proposed depletions represent aquatic impacts not previously <br />analyzed through the Section 7 process. FWS recognizes that the preliminary <br />interest expressed by various water users may not accurately reflect the <br />amount of water actually sought or successfully acquired during the formal <br />bidding process; i.e., an expression of interest in the water does not <br />necessarily mean that a particular user entity will be a successful bidder for <br />Ruedi water. Therefore, the amount of depletion impacts attributed to the <br />Round II Ruedi sale, as well as scope of impacts to listed species that have <br />already been consulted on through the Section 7 process may change, depending <br />on final outcome of the bidding process. As noted above, any impacts to <br />listed species resulting from this sale and not previously analyzed will be <br />evaluated through separate consultations once the successful bidders are <br />known. <br /> <br />BIOLOGICAL OPINION <br /> <br />Based upon the best scientific and commercial information that is currentl <br />available, the Ruedi Reservoir Round II Water Marketing Program, as described <br />below, is not likely to jeopardize the continued existence of the Colorado <br />squawfish (Ptychocneilus lucius) with the inclusion of conservation measures <br />described in this opinion. Carrying out the specified conservation measures <br />should also offset impacts to the bony tail chub (Gila !le~~ns) and humpback <br />chub (Gila cypha). <br /> <br />PROJECT OESCRIPTION <br /> <br />Narrative presented in this section describes the Federal action for which <br />this biological opinion is rendered. The water marketing information <br />presented in this section was obtained from the biological assessment (BR, <br />1984a), and from supplemental information received from your agency, most <br />notably the postsale operation study (BR, 1984b)_ <br />
