"........"..................._....".......""""....."..."......""""........................................".."" <br /> <br />natural hydrograph based on the research, and (5) legal protection for the =ervoir releases to <br />and through the endangered fish habitat to Lake Powell and a commiunentto develop a <br />Recovery Implementation Program for the San Juan River. <br /> <br />In fulfillment of element (5) described above, a Memorandum of Understanding (MOtI) was <br />executed on October 24, 1991. Signatory parties are the Department of the Interior; States of <br />Colomdo, New Mexico, and Utah; the Southern Ute, Ute Mountain Ute, and Jicarilla-Apache <br />Indian Tribes; and the San Juan Watr.r Commission and La Plata and Animas-La Plata Waler <br />Conservancy Districts. <br /> <br />Construction on three of the projea feacun:s in Phase I - Ridges Basin Dam and Reservoir, <br />Ridges Basin Inlet Conduit, and Durango Pumping Plant - would be initiated during the <br />7-y= study period. The initial depletion of 57,100 acre-feet permitted by the first element of <br />the reasonable and prudent alternative (equivalent to a total water withdrawal of 80,100 acre- <br />feet) is a smaller depletion than the 154,800 acre-feet for full development of the project <br />(195,400 acre-feet total withdrawal). Future development of the project will be dependent on <br />the outcome of the biological studies tequired by the reasonable and prudent alternative. <br /> <br />Phase II of the authorized project would provide for irrigation service to 24,645 a= and <br />additional recreation and fish and wildlife mitigation feacun:s at a total estimated cost of <br />S154,085,OOO (Oclober 1992 price levels). The Indian tribes would receive irrigation service <br />to 1,413 acres and municipal and industrial water service under Phase I of the project. The <br />tribes would also receive irrigation service to 12.367 acres under Phase II of the project. <br /> <br />Appropriation Ceiling: <br /> <br />Appropriations authorized are 51,426,635,000 (October 1992) for this project and other <br />projects authorized by Public Law 90-537. The comparable Federal obligation is <br />51,479,476.072 which does not exceed the appropriation ceiling by more than 5 percent, nor <br />the amount of contingencies included in the obligation, Estimating data are not firm enough <br />to determine if additional appropriation ceiling is necessary. The siruation will be analyzed <br />periodically as new and more precise data becomes available to determine the impact of the <br />changes. Appropriate congressional comminees will be advised of the appropriation ceiling <br />status for this project.
