l7

C~179~)

.

WATER RIGHTS

.

Table 4 lists pertinent data concerning water rights of
ditches and reservoirs in the Purgatoire valley between the dam site
and the mouth of the river, exclusive of works located on tribu-
taries. Since numerous transfers have taken place, Table .5 is in-
cluded to show the grouping of decrees by ownerships, in order of
their present location on the river below the dam site and as shown
on drawings 256-D-l09 and 256-D-IIO.
Upstream Rights
Since the water supply studies are based on recorded flows
at Trinidad, past upstream diversions are automatically taken into
account. It is not anticipated there will be future stream depletion
to affect adversely the use of water below the dam site.
Trinidad and Vicinity
All decrees listed in Table 5, except the Nine Mile and
the Highland, apply to this area. The Model Reservoir of l.5,OOO
acre-feet capacity, and Johns Lake, of 345 acre-feet capacity, are
units of the Model system and are the only storage facilities in
the valley. They are served by the Model and Johns Flood canals
operating in accordance with the recent "Parks" decision, which
allows reservoirs to store water in accordance with their legal
priority. Before the decision, all direct flow rights were accorded
seniority over all storage rights.

.
