<br />I. The Summary Report describes concepts only, for inclusion in suitable agreements, following further discussion of concepts 000 preparation of
<br />appropriate memorandums of understanding.
<br />2. All of the foregoing water rights would be allocated os portrayed with reservations and conditions to maintain and ensure the interests of such parties
<br />as follows:
<br />a. 1he USSR would fully control the operation of Blue Mesa Res. and other Curecanti units hut would stipulate to operate its Curecanti Unit and the
<br />Gunnison Tunnel to achieve the TNC goal of dedicating 0 minimum stream flow of 300 cfs from Blue Mesa to the vicinity of Austin downstream of
<br />the confluence. The minimum streamflow would, in effect, commence below Crystal f)om.
<br />b.. P&M(USBR would develop the Dominguez Project under 0 develc!pment(repoymen1 oqreement including 0 hydro development up to 500 MW. Such
<br />agreement would reserve for first-right-of-refusaltwo 10,000 AFY industrial unit~ for P&.M. P&.M also may reserve 91,000 AFY for development by
<br />its porent componY..l}f they conclude it is in their best interest. A repayment formula to compensate P&.M for any future industrial wate-r soles of
<br />the remaininq '16,000 AFY entitlement under the transferred decrees to other developers would be prepared and executed by P&M Cl"\d USBR.
<br />c. The 800 cfs diversion-conveyance flow right would be transferred to Dominguez to support recreattonal, piscatorial &. wildlife allocations, except
<br />for 100 cfs transferred to Blue Mesa.
<br />3. The Decree for the Gunnison Main Project provides for develqpment of water for consumptive use, to wit, the contemplated draft, in the amounts
<br />shown in Col. 4 (see Table I hereof and Annexure A hereto). The minimum consumptive use contemplated in the J)eCTee and the support therefore is
<br />1361000 AFY, and the single unified project concept of the decree clearly supports an allocation of the contemplated draft (unrl~r structures L-62 and
<br />L-6q and a portion of structure L-63) of 20,000 AFY for minimum streamflow maintenance, and on allocation under the remaininq slructur~5 of
<br />116,000 AFY for transfer to the Dominguez Reservoir, all os derived in Annexure A hereto. The transfer and ollocntion of the wafer ri9hls under the
<br />Summary Report provided for review contemplates the transfer and allocation to TNC by irrevocable donation of 20,000 AFY of firm Yield under three
<br />water rights as indicated above to support 0 minimum streamflow of 300 cfs os portrayed on Exhibits A CI'ld B hereto and for subseqJent transfer to
<br />CWeB for operation by a 5imilarly irrevocable property transfer.
<br />4. This Summary Report also con1emplates the reservation and alloco'ion of 116,000 AFY to P&M/USBR for joint development 01 thf! OominQuez
<br />R!!servoir site os contem~lated in the Gunnison Interim Report by T &K. It should be noted that the USBR at project level has reviewed and concurs
