<br />42 <br /> <br />With protective prOV1Slons included in the reasonable and prudent alternative <br />contained herein, the Service does not anticipate that construction and <br />operation of the proposed Project will result in any incidental take of <br />Colorado squawfish or razorback sucker. The Service anticipates that a small <br />number (not to exceed 3 adults Colorado squawfish or 3 adult razorback sucker) <br />of endangered fish could be taken as a result of the research program which is <br />part of the reasonable and prudent alternative to preclude jeopardy. <br />Incidental take would be associated with activities, such as capture, holding, <br />or transporting fish, required by the research program, but would be covered <br />by threatened and endangered species collection permits and would require <br />immediate notification and cessation of any activity resulting in a take until <br />further Service review. <br /> <br />The following reasonable and prudent measure is necessary and appropriate to <br />minimize take and is required for all research funded or implemented by <br />Reclamation. <br /> <br />A permit which will include measures to reduce take will be obtained <br />in accordance with 50 CFR 17.22 and 32 from the Fish and Wildlife <br />Service. <br /> <br />In order to be exempt from the prohibitions of section 9 of the Endangered <br />Species Act, the applicant must comply with the following terms and conditions <br />which implement the reasonable and prudent measure described above. <br /> <br />1. Every effort will be made to prevent mortality of young-of-the-year <br />fishes. Only those fish that cannot be accurately identified in the field <br />may be sacrificed. <br /> <br />2. The following electrofishing procedures will be implemented. <br /> <br />a. Electrofishing equipment should be calibrated each year under <br />controlled laboratory conditions. Wave forms should be measured to <br />ensure that spiked wave forms are not being produced and that no <br />reversal of polarity is encountered. <br /> <br />b. Only persons with field or formal training in electrofishing methods <br />and one or more field seasons of experience are authorized to use this <br />method. <br /> <br />c. Electrofishing should use direct current (D.C.) only. When pulsed <br />D.C. current is used, rectangular wave forms at pulse frequencies of <br />40 pulses per second or less should be used. <br /> <br />d. Electrofishing should be restricted to waters in which conductivity <br />measures less than 1,000 micro mhos per cm. <br /> <br />e. All tissue collection shall follow the protocol outlined in the report <br />titled "Razorback Sucker Genetic Survey--Tissue Sampling Protocol." <br />
