The releases shall be limited by the inflow to the diversion dam at <br />any instant in time. If the inflow is not adequate to make the release, <br />the inflow into the diversion dam shall be released. <br /> <br />4. At any time the Company is spilling or releasing water in addition <br />to that designated above, it will be assumed that the Company could not <br />have diverted the water being released and will not receive credit for <br />the water being released as exchange water. <br /> <br />5. The total volume of the release shall not exceed 3,000 acre-feet in <br />anyone water year, but it may be any volume less than 3,000 feet. <br />
