<br />,....j <br />:.-....... <br />,:J <br />....-l <br />~:) <br />(;:J <br /> <br />COLORADO WATER CONSERVATION BOARD <br />721 STATE CENTENNIAL BUILDING <br />1313 SHERMAN STREET <br />DENVER, CO B0203 <br /> <br />May 3, 1985 <br /> <br />RES 0 L UTI 0 N <br /> <br />WHEREAS, Public Law 92-514, as amended by Public Law 96-375, <br />authorizes the Secretary of the Interior, hereinafter referred to <br />as the IISecretarYJ II to cons'truct, operate, and maintain the <br />Closed Basin Division, San Luis Valley Project, Colorado, herein- <br />after referred to as the "project"; and <br /> <br />WHEREAS, Section lOl(b) of said public law provides that: <br />"Construction of the project may be undertaken in such units or <br />stages as in the determination of the Secretary will best serve <br />project requirements and meet water needs: Provided, that <br />construction of each of the successive units or stages after <br />stage 1 of said project shall be undertaken only with the consent <br />of the Colorado Water Conservation Board and the Rio Grande Water <br />Conservation District.. ."; and <br /> <br />WHEREAS, the Secretary, acting through the U.S. Bureau of <br />Reclamation, desires to initiate the drilling of salvage wells <br />and the acquisition of land needed for such wells in stage 5 of <br />the project in federal fiscal year 1986 in order that such wells <br />might be pump tested so that data can be obtained for the subse- <br />quent design of pumps and distribution pipes; and <br /> <br />WHEREAS, all such wells will be capped after test pumping <br />and not placed into production until the Colorado Water Conserva- <br />tion Board and the Rio Grande Water Conservation District consent <br />to the same. <br /> <br />NOW THEREFORE, BE IT RESOLVED by the Colorado Water <br />Conservation Board in regular session assembled at Denver, <br />Colorado, this 3rd day of ~Iay, 1985, that the Board does hereby <br />consent to the drilling of salvage wells and the acquisition of <br />the land needed for such wells in stage 5 of the project so long <br />as: (1) all such wells are capped after being pumped tested and <br />not put into production until the consent of the Colorado Water <br />Conservation Board and the Rio Grande Water Conservation District <br />has been given to place such wells in production, (2) the project <br />proceeds in substantial conformity with the Definite Plan Report <br />for said project, (3) the U.S. Bureau of Reclamation proceeds <br />with diligence in the construction of stages 1-2, 3, and 4 of the <br />project, and (4) construction of such wells is in compliance with <br />applicable state law. <br /> <br />713 <br />res/jul <br />
