In carrying out this policy, the Federal Government is to use all practicable means to: (1) fulfill the responsibilities of each generation as trustee of the environment for succeeding generations; (2) assure for all Americans safe, healthful, productive, and esthetically and culturally pleasing surroundingsl (3) attain the widest range of beneficial uses of the environment without degradation, risk to health or safety, or other undesirable and unin- tended consequences; (4) preserve important historic, cultural, and natural aspects of our national heritage, and maintain, wherever possible, an environment which supports diversity and variety of individual choice; (5) achieve a balance between popu- lation and resource use which will permit high standards ,of living and a wide sharing of life's amenities; and (6) enhance the quality of renewable resources and approach the maximum attain- able recycling of depletable resources. This mandate has not been followed in FES as hereinafter set forth. 19. National Environmental Policy Act (NEPA) requires that defendants conduct a full, good faith consideration, balancing and review of the Narrows in light of its environmental impact in order to comply with the mandate "to use all practicable means" to bring the- Narrows into conformance with the- policies and goals expressed in NEPA. Defendants have failed to do this. 20. By defendants failing to comply with NEPA prior to decision making, to submit FES "as early as possible" (38 Fed. Reg. 20552), to follow the guidelines of the Council on Environmental Quality (CEQ), to comply with the rules and -7-
