<br />and promote the general welfare, to create and maintain" <br /> <br />conditions under which man and nature can exist in productive <br /> <br />harmony and fulfill the social economic and other require- <br /> <br />ments of present and future generations of Americans~1I 42 <br /> <br />D.S.C. Sec. 4331(a). In carrying out this policy, the <br /> <br />Federal Government is to use all practicable means to: <br /> <br />(1) fulfill the responsibilities <br />of each generation as trustee of the <br />environment for succeeding generations; <br /> <br />(2) assure for all Americans safe, <br />healthful, productive, and esthetically <br />and culturally pleasing surroundingsl <br /> <br />(3) attain the widest range of <br />beneficial uses of the environment <br />without degradation, risk to health or <br />safety, or other undesirable and unin- <br />tended consequences; <br /> <br />(4) preserve important historic, <br />cultural, and natural aspects of our <br />national heritage, and maintain, wherever <br />possible, an environment which supports <br />diversity and variety of individual choice; <br /> <br />(5) achieve a balance between popu- <br />lation and resource use which will permit <br />high standards ,of living and a wide sharing <br />of life's amenities; and <br /> <br />(6) enhance the quality of renewable <br />resources and approach the maximum attain- <br />able recycling of depletable resources. <br /> <br />This mandate has not been followed in FES as hereinafter <br /> <br />set forth. <br /> <br />19. National Environmental Policy Act (NEPA) requires <br />that defendants conduct a full, good faith consideration, <br />balancing and review of the Narrows in light of its <br /> <br />environmental impact in order to comply with the mandate <br /> <br />"to use all practicable means" to bring the- Narrows into <br /> <br />conformance with the- policies and goals expressed in NEPA. <br /> <br />Defendants have failed to do this. <br /> <br />20. By defendants failing to comply with NEPA prior <br /> <br />to decision making, to submit FES "as early as possible" (38 <br /> <br />Fed. Reg. 20552), to follow the guidelines of the Council on <br />Environmental Quality (CEQ), to comply with the rules and <br /> <br />-7- <br />
