Section V. Section bv section analvsis of the Purnosed Rule Section
414.4. in the 1st column:
The reponing and accounting of the storing and J"6demption of credils is vital. The
SecretaIy and others must be able to verify wilh confidence the operations under
inrerstatc water storage agreements and certify water storage and delivexy. The rule
should be strengthened to provide for the verification and certification of the reporting
and accounting of storage and J"6dempti01l credits.

Pal!e 68496. Section V. Section bv section analvsis of the Puroosed Rule. Section
414.5. in the 3rd column:
The rule should state that the evaluation of iIlIpacl~ was based on the Colorado River
Salinity Standards CUIrentIy in place. The rule should acknowledge that the Colorado
River Salinity Control Program currently in place provides the means to offset any
increase in salinity as a result of implementing the proposed rule. This
acknowledgment should also be included in the EA by adding a new section to the EA
on water quality so that the EA fully supportS the rule.

Paste 68497 Section VI. l'roceduraI Maners. 3rd column. 1st uanl!Illuh:
It is noted herein that, "the only water that can be used to satisfy storage credits is
unused apportionment creared by the forbearance of a use which would have otherwise
occurred." It would be helpful to include this language in the section by section
analysis under section 414.3.

Page 68498. Proposed Rule. Part 414.1. Pwvose. 2nd column:
We suggest that the following language be included in the "Purpose": "The actions
contemplated by the rule are deemed to be within the current authority of the Secretary
under the body of law known as the 'Law of the Colorado River.' It is not the intent of
this rule to cbange Or expand the authorities UDder the 'Law of the Colorado River. '
Nothing in the rule ehanges the apportionments made to individual states under the
'Law of the Colorado River.' The only intent of the role is to provide for the effICient
use of nnnsed apportionment and $lllpluscs within the 'Law of the Colorado River' in
the Lower Division States. Water users shall not be entitled to rely on supplies that
become temporarily available under this role beyond the provisions of specific interstate
water storage agreements approved by the Secretary_All states should plan upon living
within the apportionments made to them under the 'Law of the Colorado River' .
