<br />I. <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />000488 <br /> <br />Nevada Proposed Version of <br />Off stream Storage Rule <br />April 3, 1998 <br /> <br />(1) SpecifY the quantity of Colorado River water to be stored and the Lower <br />Division State in which it is to be stored, and generally describe the entities by which it will be <br />stored and the storage facilities in which it will be stored. <br /> <br />(2) SpecifY that the water to be stored will be within the basic apportionment <br />or the surplus apportionment of the Storing State or unused basic apportionment or surplus <br />apportionment of the Consuming State and acknowledge that any unused apportionment of the <br />Consuming State may only be made available by the Secretary to the Storing State in accordance <br />with Article II(B)(6) of the Decree. <br /> <br />(3) SpecifY the maximum quantity of intentionally created unused <br />apportionment that will be available for release and delivery to the authorized entity in the <br />Consuming State pursuant to the agreement. <br /> <br />(4) SpecifY that intentionally created unused apportionment may not be <br />requested by the authorized entity in the Consuming State in an amount that exceeds the amount <br />of water then in storage pursuant to an Interstate Storage Agreement in the Storing State. <br /> <br />(5) SpecifY that, by a date certain to be specified in the Interstate Storage <br />Agreement, the authorized entity in the Consuming State will provide notice to the Lower <br />Division States and to the Secretary of its request for release of a specific quantity of intentionally <br />created unused apportionment in the following calendar year. <br /> <br />(6) SpecifY that an authorized entity in a Storing State, after receiving a notice <br />of a request for release of a specific quantity of intentionally created unused apportionment, will <br />take actions to ensure that the Storing State's consumptive use of Colorado River water will be <br />decreased by a quantity sufficient to develop the requested amount of intentionally created unused <br />apportionment to be released for use in the Consuming State.. <br /> <br />(7) SpecifY which types of actions may be taken in the Storing State to develop <br />intentionally created unused apportionment. <br /> <br />(8) SpecifY that an authorized entity in the Storing State must certifY to the <br />Secretary that, for the year in question. intentionally created unused apportionment has been or <br />will be developed that would not otherwise exist; the quantity and the means and the entity by <br />which such unused apportionment has been or will be developed, and that the Secretary is <br />requested to release that quantity of intentionally created unused apportionment pursuant to <br />Article 1I(B)(6) ofthe Decree for use, and delivery to the authorized entity in, the Consqming <br />State. <br /> <br />4 <br /> <br />0208826.. <br />
