Curreutly, the Proposed Rule is written 50 that aD approvals are by <br />the Secretary of the Interior. The final Rule should contain a provision fur these approvals to be <br />delegated to the &:gional Director with anappeal oCtile RegiooalDirector's decision to the Secretary <br />oCtile Interior. <br /> <br />Section 5 WAt.... Dclivety Contracts <br /> <br />The Proposed Rule docs not specify who needs a water delivery contract pursuant to Section S of <br />the Bouldcr Canyon Project Act. In acc:ordante with the 1964 Decree in Arizona v. California it <br />would secmthat 8DYcntitythat diverts waterfromthe mainstream of the Colorado Rivcrwould need <br />such a contract, even if tbe water being diverted is a result of "intentionally created unused <br />apportionment" or if the diversion woxks of another entity, who has a contract, is used. <br />
