"'h(ID <br />~~~:~'-::'-' . . <br />L:.::.::._:-Yd. <br /> <br />Dear Mr. Enllminger: <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />The Colorado River Board of California appreciates the opportunity to provide comments on the <br />Proposed Rule, "OftStream Storage of Colorado River Water and Interstate Redemption of Storage <br />Credits in the Lower Division states" (Proposed Rule), 43 CFRPart 414, which WlIS published in the <br />Federal Register on Decl'JnlvT 31, 1997, as a Notice of proposed rule IT1Alring. In a memorandum, <br />dated February'13, 1998, to parties interested or potentially interested in the Proposed Rule, the <br />United States Bureau ofRcclamation (Reclamation) extended the co.........,;...t deadline until the close <br />ofbl...mr-on April 3, 1998. The Colorado River Board ofCalifuroia is charged with safeguarding <br />and protecting the rights IUld interests of the State, its agencies, and its citizens in and to the water <br />of the Colorado River System and the use thereof Agencies within California have utilized water <br />apportioned to, but unused by Arizona and Nevada, as wen as surplus water in the past. and we are <br />concerned with implementation of the rule, as proposed, may have adverse affects on the availability <br />of water to Califumia. . <br /> <br />The foBowiDg COmtYlel1tl; are being provided by the Colorado River Board of Califumia on the <br />Proposed Rule, at this time. Additional comments may be sent to Reclamation fullowing the <br />COUIl.....1t deadline, further expressing the views of the Board. <br /> <br />Focus of the Pronosed Rule <br /> <br />The Proposed Rule should focus only on allowiDg the interstate stomge. recovery. and transfer of <br />water in the Arizona Water Bank. since Reclamation has: 1) limited the Proposed Rule to address a <br />wrynanowaspect oftlAl1!.feuiugwaterinterstate, 2)promu/gated theProposed Rulcto comply with <br />requirements of1egislation passed by the Arizona lcgislatme, and 3) addressed a specific desire by <br />the State of Nevada to have water stored on its bebalfin the Arizona Water Bank. In this regard, <br />Califumia's needs, desires, and input,. for the most part, have had very little bearing on the focus and <br />contents of the Proposed Rule. <br />
