<br />of water from Hunter Creek and two
<br />tributaries of that stream and min-

<br />George Kregger, Fryingpan-Ar-
<br />kansas project manager, said con-
<br />struction continues on the following,
<br />-Completing lining of the Hunter
<br />Tnnel, from Chapman Gulch to
<br />Hunter, Creek and to the two tribu-
<br />taries, Midway and No Name. Diver-
<br />sion structures have been built;
<br />-Lining Mormon and Carter tun-
<br />nels of the Northside Collection
<br />System;
<br />-Several diversion points for Cun-
<br />ningham Creek and North Fork of the
<br />Fryingpan,
<br />The 1978' diversion of water from
<br />the Fryingpan River and several
<br />tributaries totaled 48,355 acre-feet up
<br />to Tuesday morning, Target for this
<br />year is 49,000 acre-feet. Kregger said
<br />diversion probably will end within a
<br />week.
<br />Construction of Granite Siphon will
<br />start soon,
<br />Felix Sparks, director of the Colo-
<br />rado Water Conservation Board, is in
<br />Washington this week to present a pro-

<br />feet of water from Hunter Creek and
<br />the two tributaries, The tributaries
<br />flow into the main creek below the
<br />Hunter Creek diversion point.
<br />The Fryingpan-Arkansas Commis-
<br />sion last week approved the proposed
<br />amendment. There are two avenues
<br />for action: Attaching the amendment
<br />to an appropriations bill as a rider or
<br />directly amending the authorization
<br />law,
<br />Leo M, Krulitz, attorney for the U,S,
<br />Department of the Interior, ruled,in
<br />June a change in the authorization
<br />law would be necessary for the Bu-
<br />reau of Reclamation to divert water
<br />from Hunter Creek and tributaries,
<br />The feasibility plan provided for di-
<br />version of 3,000 acre-feet of water to
<br />the Twin Lakes Canal Co, Twin Lakes,
<br />in exchange, would agree not to divert
<br />water from the Roaring Fork River.
<br />Agreement between the south-
<br />eastern board and the Colorado River
<br />Water Conservation District call for
<br />average annual diversion of 69,000
<br />acre-feet of water to Eastern Colo-
<br />rado, The bureau decided against tap-
<br />ping Lime and Last Chance creeks,
<br />The agency then decided to in-
<br />crease diversions from Hunter Creek.
<br />Pitkin County groups protested the
<br />larger Hunter Creek diversions were
<br />not legal under the legislation author-
<br />izing the project. Krulitz agreed with
<br />them,
<br />If Krulitz' opinion stands and if Con-
<br />
<br />
<br />gress does not amend the author-
<br />ization law, a return to diverting
<br />water from Lime and Last Chance
<br />Creeks might be necessary,
<br />The U.s, Fish and Wildlife Service
<br />earlier this year' proposed to study
<br />Carter, North Fork, Mormon, North,
<br />Middle and South Cunningham creeks
<br />to determine if minimum stream flows
<br />provided in the operating principles
<br />for the Fryingpan-Arkansas Project
<br />should be larger,
<br />The Fryingpan-Arkansas Commis-
<br />sion voted last week the amounts of
<br />water to be by-passed at diversion
<br />points of the project would not be
<br />changed and that water for minimum
<br />flows would have to come from other
<br />sources.
<br />The Fish and Wildlife Service ear,
<br />lier determined the minimum flow in:
<br />Hunter Creek should be 21 second-
<br />feet of water instead of 14 second-feef
<br />proposed by the Bureau of Reclama-
<br />tion and the Southeastern Colorado
<br />Water Conservancy District. The de-
<br />termination was in response to an ap-
<br />plication for a dredge and fill permit
<br />
<br />from the Army Corps of Engineers,
<br />Before the board of the south-
<br />eastern district board could make a
<br />decision on the minimum stream flow,
<br />the Krulitz ruling tossed the matter
<br />into the political arena,
<br />
<br />Kreggerwas optimistic that negotia-
<br />tions concerning the dredge permit
<br />the minimum flows for Hunter Creek
<br />and the amount of water that may be
<br />diverted from Hunter Creek and its
<br />tributaries can be resolved,
<br />Dredge and fill refers to structures
<br />placed in a stream as well as to re-
<br />moval or placing dirt in a stream,
<br />The dredge and fill application is a
<br />package deal, covering the several
<br />.structures under construction and
<br />Granite Siphon,
<br />
<br />The Albuquerque, N,M" office of
<br />the corps has forwariled the package
<br />application to the Washington office
<br />of the agency for decision, Kregger ex-
<br />pressed the opinion the application
<br />for the Granite Siphon might be de-
<br />cided separate because it does not in-
<br />volve any fish flows,
