Diver-
sion structures have been built;
-Lining Mormon and Carter tun-
nels of the Northside Collection
System;
-Several diversion points for Cun-
ningham Creek and North Fork of the
Fryingpan,
The 1978' diversion of water from
the Fryingpan River and several
tributaries totaled 48,355 acre-feet up
to Tuesday morning, Target for this
year is 49,000 acre-feet. Kregger said
diversion probably will end within a
week.
Construction of Granite Siphon will
start soon,
Felix Sparks, director of the Colo-
rado Water Conservation Board, is in
Washington this week to present a pro-
posed amendment to the 1962 IJlw au-

\,

\,-

~'

~J

'-
".'-.
-1..

1
,-
"
;
;
~
.~
),

i
.:(
"

...4

/:\~

:.::
:,.
'f.

thorizing the Fryingpan-Arkansas
Project for diversion of 10,300 acre-
feet of water from Hunter Creek and
the two tributaries, The tributaries
flow into the main creek below the
Hunter Creek diversion point.
The Fryingpan-Arkansas Commis-
sion last week approved the proposed
amendment. There are two avenues
for action: Attaching the amendment
to an appropriations bill as a rider or
directly amending the authorization
law,
Leo M, Krulitz, attorney for the U,S,
Department of the Interior, ruled,in
June a change in the authorization
law would be necessary for the Bu-
reau of Reclamation to divert water
from Hunter Creek and tributaries,
The feasibility plan provided for di-
version of 3,000 acre-feet of water to
the Twin Lakes Canal Co, Twin Lakes,
in exchange, would agree not to divert
water from the Roaring Fork River.
Agreement between the south-
eastern board and the Colorado River
Water Conservation District call for
average annual diversion of 69,000
acre-feet of water to Eastern Colo-
rado, The bureau decided against tap-
ping Lime and Last Chance creeks,
The agency then decided to in-
crease diversions from Hunter Creek.
Pitkin County groups protested the
larger Hunter Creek diversions were
not legal under the legislation author-
izing the project. Krulitz agreed with
them,
If Krulitz' opinion stands and if Con-

gress does not amend the author-
ization law, a return to diverting
water from Lime and Last Chance
Creeks might be necessary,
The U.s, Fish and Wildlife Service
earlier this year' proposed to study
Carter, North Fork, Mormon, North,
Middle and South Cunningham creeks
to determine if minimum stream flows
provided in the operating principles
for the Fryingpan-Arkansas Project
should be larger,
The Fryingpan-Arkansas Commis-
sion voted last week the amounts of
water to be by-passed at diversion
points of the project would not be
changed and that water for minimum
flows would have to come from other
sources.
The Fish and Wildlife Service ear,
lier determined the minimum flow in:
Hunter Creek should be 21 second-
feet of water instead of 14 second-feef
proposed by the Bureau of Reclama-
tion and the Southeastern Colorado
Water Conservancy District. The de-
termination was in response to an ap-
plication for a dredge and fill permit

from the Army Corps of Engineers,
Before the board of the south-
eastern district board could make a
decision on the minimum stream flow,
the Krulitz ruling tossed the matter
into the political arena,

Kreggerwas optimistic that negotia-
tions concerning the dredge permit
the minimum flows for Hunter Creek
and the amount of water that may be
diverted from Hunter Creek and its
tributaries can be resolved,
Dredge and fill refers to structures
placed in a stream as well as to re-
moval or placing dirt in a stream,
The dredge and fill application is a
package deal, covering the several
.structures under construction and
Granite Siphon,

The Albuquerque, N,M" office of
the corps has forwariled the package
application to the Washington office
of the agency for decision, Kregger ex-
pressed the opinion the application
for the Granite Siphon might be de-
cided separate because it does not in-
volve any fish flows,

Service News

HANAU, Germany-Private Eugeue
H.
