ALP Supply granted to Tribe in Settlement Agreement <br />a. 6,000 AF\YR for M&I purposes available in Phase IA (R&P alternative) <br />b. 26,300 AF\ YR for Agriculture available in Phase 1B <br />c. 900 AF\YR for Agriculture available in Phase IT <br />2. Delivery Point <br />Ridges Basin Reservoir or on the Animas River at the inlet to the Durango pump until Phase <br />1B and Phase IT facilities are complete. <br />3. Options <br />If Ridges Basin Reservoir, Long Hallow Tunnel and Dry Side Canal to Dry Side Lateral are <br />not complete by January 1,2000 then by January 1,2005 the tribe must elect to: <br />a) retain the ALP supply in I above <br />b) commence litigation or renegotiation of its pending reserved water right claims on the <br />Animas and La Plata Rivers <br />i) If no action, tribes retain ALP supplies, settlement becomes final and no additional <br />claims can be made on the Animas and La Plata Rivers <br />ii) If tribes litigate or renegotiate, they relinquish all quantifications on the Animas and <br />La Plata Rivers in the December, 1986 Agreement; provided the Tribe can <br />reconsider if the project is subsequently completed. <br /> <br />Southern Ute Indian Tribe <br /> <br />1.
