Accordingly, the Upper <br /> <br />Division would be able to deliver at Lee Ferry in excess of 8.25 maf, <br /> <br />that is 7.5 maf plus one-half of the Treaty obligation, well past <br /> <br />2005 even though New Mexico, as it may under the provisions of <br /> <br />Article III(b) of the Upper Basin Compact, has used more t~an its <br /> <br />share of the hypothetical Upper Basin entitlement of 5.8 maf. This <br /> <br />'-. excess was found sufficient to support consumptive uses of 100,000 <br /> <br />acre-feet annually in New !-1exico under municipa.l and industrial <br /> <br />con-tractS terminating in 2005. <br /> <br />The New Mexico Interstate streem Commission concurred in <br /> <br />- <br />the 2005 term for contracts ~o long as it did not inhibit the <br /> <br />development and use of New Mexico's water resources. <br /> <br />It is, of <br /> <br />course, New Mexico's position that at least the full amount <br /> <br />of 100,000 acre-feet will be available for such contracts in per- <br /> <br />petuity. <br /> <br />On the basis of the Secretary's determination the Congress, <br /> <br />with the support of the State, in 1968 authorized (PL 90-272) the <br /> <br />Secretary to enter a contract with Southern Union Gas Company for <br /> <br />50 acre-feet annually for cooling in a compressor station; a con- <br /> <br />tract with the Public Service Company of New Mexico for the diver- <br /> <br />sion of 20,200 acre-feet of water, a part of which is now being <br /> <br />used for the operation of the company's San Juan power plant near <br /> <br />the Four Corners; and a contract withptah Construction & Mining <br /> <br />Company for a diversion of 44,000 acre-feet annually. <br /> <br />It now <br /> <br />appears that water under this latter contract will be used for <br /> <br />coal gasification units on the Navajo Reservation with a total <br /> <br />capacity of 1 billion cubic feet per day. These units would be <br /> <br />constructed on the ~avajo Reservation to process !)avajo coal. <br /> <br />._11'._ <br />
