<br />5. Well field laterals to deliver the pumped ground waters to
<br />the conveyance channels. '!'hese laterals would total about 92 miles in
<br />length and vary in capacity from 0.6 c.f.s. to 20 c.f.s.

<br />6. Highway and railroad crossings, county and farm bridges,
<br />surface drain and lateral inlet structures, and other misc,ellaneous structures,
<br />and access and operating roads.

<br />7. Basic recreational facilities would be provided at San
<br />Luis Lake, and the Mishak Lakes National Wildlife Re:t'u&e would be
<br />developed as a project feature. ~asures to improve fish habitat in the
<br />conveyance channels and to aerate the pumped ground waters would be provided
<br />in accordance with recommendations of the Bureau of Sport Fisheries and
<br />Wildlife and the Colorado Department of Game and Fish.

<br />'!'he plan contemplates use by the Alamosa Nat10nal Wildlife Refuge
<br />of 5,300 acre-feet of salvaged waters annua:L:q, with diversd:.on of suchwiiter
<br />to be provided for as part of development of that re:t'u&e. It also provides
<br />for nominal use of salvaged waters to provide water supplies for fish hatch-
<br />eries which are being considered for construction in the Closed Basin.

<br />strongly endorsed this position and cite the 1906 Treaty with the
<br />United States of ~xico and the Rio Grande CQmpact of 1929 as
<br />authority for 'this position. Article II of the 1929 Coru;pact as
<br />approved by Congress by the Act of June 17, 1930, is quoted:

<br />"( a) That they recosnize the paramount right and duty of the
<br />United States, in the interes'ts of international peace and harlllODY, to
<br />determ:lne and settle international controversies and claims by treaty,
<br />and tbat when those purposes are accoru;plished by that means the treaty
<br />becomes the supreme law of the Nation;
<br />
<br />It(b) That since the benefits which flow from the wise
<br />exercise of that authority and the just performance of tha't duty accrue
<br />to all the people, it follows as a corollary that 'the Nation should
<br />defray the cost of the discharge of any obligation thus assumed;
<br />
<br />!t(e) '!'hat with respect to the Rio Grande, the United States,
<br />without obligation imposed by international law and 'being moved by con-
<br />siderations of international comity, I entered into a treaty dated May 21,
<br />1906 ('!'hirty-fourth Statutes, page '2953), with the United States of
