Monthly values of return flows from the subject
water rights are provided as Table A-5 and A-6 (Appendix A) for the Pioneer Union and
Hodgson Ditches, respectively.

Table 4
Historic (1938-1957 averages) Depletions and Returns
acre-feet

Depletions

Return Flows

Pioneer Union

225.6
18.7
244.3

299.2
28.5
327.7

Hodgson
Totals

II,S Historic vs, FullJfe Potential Consumptive Use

The applicant proposes that 14.569 shares in the Pioneer Union Ditch and 32,5 shares in the
Hodgson Ditch continue to be used for irrigation on land adjacent to Bear Creek in the vicinity
of the Pioneer Union Ditch, Diversions will be made through the Pioneer Union Ditch. The
acreage irrigated will consist of approximately 140 acres of lawn grass associated with the
proposed Fox Hollow Golf course located physically above the Pioneer Union Ditch and/or on
the south side of Bear Creek, Even though the proposed use will continue to be irrigation and
the proposed amount of irrigated acreage is proposed to be less than that historically irrigated,
the substitution of lawn grass for the historic irrigated crops will alter the use from that
experienced historically.

The potential increase in the consumptive use of water resulting from the irrigation of lawn grass
rather than the historic crops is shown in Table 5. This table demonstrates a major concern of
the objectors, The next section suggests terms and conditions, assuming the court were to rule
that Lakewood's future Golf Course use be restricted to historic diversions and depletions,

Under this scenario, Lakewood would divert its prorata share of decreed rates, subject to historic
volumetric limits, Lakewood would maintain historic return flows with bypassed flows or other
replacement water available to it.

5

~ Leonard Rice Consulting Waler Engineers.
