INTRODUCTION <br /> <br />In December, 1990, the City of Lakewood filed a water court application (Case No. 90CW185) <br />requesting any necessary changes be made to the following interest (subject water rights) in the <br />Pioneer Union and Hodgson Ditches to allow that interest to serve portions of the proposed Fox <br />Hollow at Lakewood Golf Course, <br /> <br />. 14,569 shares in Pioneer Union Ditch (18.21 % of 80 shares associated with Pioneer Union) <br />- 32.50 shares in Hodgson Ditch (8,125% of 400 shares associated with Hodgson Ditch) <br /> <br />The legal issues presented are whether the use of Pioneer Union shares above the ditch and South <br />of Bear Creek is to be considered by the court as a change in place of use, and if so, whether <br />changing the place of use requires consumptive use analyses if irrigated acreage remains the same <br />or less, <br /> <br />In June, 1991, an engineering report titled "Preliminary Engineering Assessment of the Pioneer <br />Union and Hodgson Ditch Water Rights" was distributed to objectors. The preliminary <br />engineering analyses were based on the premise that the subject water rights could continue to <br />be used for irrigation even at a new place of use if the new acreage to be served did not exceed <br />the historic acreage served, <br /> <br />In furtherance of settlement discussions with objectors Lakewood agreed to perform comparative <br />analyses of historic consumptive use and golf course usage, This supplemental report <br />summarizes the historic use of the subject water rights assuming a change is required and the <br />future use is limited to historic diversions and depletions. This report also proposes terms and <br />conditions for such a water right change, This report deals only with subject water rights in the <br />Pioneer Union and Hodgson Ditches as indicated above and is not intended to address other <br />interest that Lakewood may have in these ditch systems, <br /> <br />II, HISTORIC USE <br /> <br />Water derived from the subject water rights in the Pioneer Union and Hodgson Ditches has <br />historically been applied for irrigation of land adjacent to Bear Creek. Historic information (Le, <br />aerial photographs, statements made by former owners, water use data) has been reviewed to <br />obtain information on the historic use of the subject water rights. The primary elements (acreage, <br />diversions, consumptive use, etc,) were input to analyses of historic water use performed with <br />a monthly time step, <br /> <br />1 <br /> <br />~ Leonard Rice Consulting Waler Engineers, Inc. <br />
