I' <br /> <br />1\,.. ~. , ., ... <br />UV'::--.ju <br /> <br />At this time, only one agreement between the CWCB and the USFS has been signed <br />utilizing the tools provided by SB,91, This agreement provided the transfer of some of the <br />USFS's water rights associated on Hunter Creek to the CWCB for [SF purposes. Table 4 <br />provides some of the details of this agreement. Through these tipes of agreements, we <br />believe that the CWCB, through the authority it has under the W AP, can address some, if <br />not all, of the instrearn flow needs of the Forest Service in the Whi!e River National Forest <br />and other national forests in the state. Table 4 provides some details of the Hunter Creek <br />Agreement as well as other contractual agreements that the CWCB has entered into with <br />other entities the White River National Forest management boundaries. [n addition, the <br />eWCB is currently cooperating with the Bureau of Land Management (ELM) to transfer the <br />water rights that the BLM has acquired through land exchange for instrearn flow uses. <br /> <br />Moniton"!!: and Enforcement ofthe cwes Instream Flows <br />The CWCB monitors all of its [SF water rights throughout the state utilizing both structural <br />and non-structural activities. These activities rely on existing USGS Gages, a network of <br />satellite gages, and numerous staff gages. [n addition, the CWCB coordinates closely with <br />the Division Engineers' offices to make sure that the Board's water rights are being <br />administered in priority, With regard to the White River National Forest, the Department of <br />Natural Resources and CWCB have nwnerous agreements in Swnrnit County that provide <br />protection for [SF water rights, Following is a listing of the agreements: <br /> <br />. Keystone & Arapahoe Basin (Snake River and Keystone Gulch) MOAs <br />. Breckenridge (Blue River) MOA <br />. Copper Mountain (Tenrnile and West Tenrnile Creek) MOA <br />. Vidler Tunnel Water Co. MOA <br />. Summit County (Upper and Lower Blue River) MOAs <br />. Clinton / Fraser MOA which includes the Denver Water Board; the towns of <br />Breckenridge, Dillon, Fraser, Frisco, Granby & Silverthorne; the Grand County Water <br />and Sanitation District; the Ski areas of Breckenridge, Copper Mountain, Keystone, and <br />Winter Park; and Grand and Swnrnit. <br /> <br />ConcIudin!!: Remarks <br />Reasonable protection of the water dependent natural environment is important to the <br />. State of Colorado. This is evident in the actions taken by the state. These actions include <br />the establishment of new laws dealing with the appropriation and use of water within the <br />state, laws to better define how instrearn flows and natural lake levels are protected, and <br />vesting the state's water planning and policy making agency with the exclusive authority <br />to deal with instream flow protection. ' <br /> <br />Furthermore, to address the desire of federal agencies and the public to actively <br />participate in streamflow protection, the legislature directed the Board to request <br />recommendations from federal land management and resource agencies as well as state <br />agencies and the public.
