Beneficial use shall <br /> <br />be the basis, measure and limit to the use of water. Whenever the owner <br /> <br />of a right to the use of water shall cease or fail to use the water <br /> <br />appropriated for five (5) successive years, the right to the use shall <br /> <br />cease, and the water shall revert to the public and be again subject to <br /> <br />appropriation." <br /> <br />The Arizona Revised Statutes pertaining to surface water law were <br /> <br />amended in 1962 by Senate Bill No. 39. This bill listed the rights of <br /> <br />the State in appropriation of water. It covers severence and transfer of <br /> <br />water rights appurtenant to crop land for municipal, stock watering, <br /> <br />power and mining, and recreation and wildlife purposes (including fish) <br /> <br />under spRcifi.ed conditions and limitations. Consent and annroval bv .all <br /> <br />interested parties must be agreed upon before any transfer of water rights <br />\ <br />may be approved. <br /> <br />Another amendment enacted under Senate Bill No. 39 during 1962 read <br /> <br />as follows: "As between two or more pending conflicting applications <br /> <br />for the use of water from a given water supply, when the capacity of the <br /> <br />supply is not sufficient for all applications, preference shall be given <br /> <br />by the department according to the relative values to the public of the <br /> <br />proposed use. <br /> <br />The relative values to the public for the purposes of this section <br /> <br />shall be: <br /> <br />1. <br /> <br />Domestic and municipal uses. <br />include gardens not exceeding <br />family. ) <br /> <br />(Domestic uses shall <br />one-half acre to each <br /> <br />2.
