<br />it will be difficult for New Mexico to justify any appreciable j),dditional
<br />development other than the Animas-La Plata project, It appears
<br />that New Mexico uses will be limited by its entitlement rather than
<br />the physical availability of the water. If the above three mentioned
<br />projects are constructed and operated additional fut.ure diversions for
<br />the San Juan-Ohama project and water for appreciable future munici-
<br />pal and industrial uses in New Mexico do not appear to be available
<br />without reduction in irrigation uses.
<br />It is my conclusion that there is sufficient water from the Animas
<br />River, with the Bureau's plan for storage, for the Animas-La Plata
<br />project and that the Animas-La Plata projec;t could be benefited by
<br />the release of water from Navajo Reservoir to meet existing natural
<br />flow rights below the confluence of the Animas and San Juan Rivers.
<br />In my opinion, the Southwestern Water Oonservation District need
<br />not be concerned that the Navajo Reservoir will be' Qverpurdened'by
<br />excessive demands because (1) the Secretary of the Interior is pre-
<br />vented by the legislation from overburdening the reservoir and (2)
<br />~ew Mexico's entitlement limits New Mexico uses to the extent that
<br />the"reservoir could not be overburdened.
<br />As I understand it, there has been no firm Lee Ferry obligation
<br />placed upon the San Juan River. It appears, however,~hl1~ there
<br />will be a substantial contribution from the ~an Juan River tpward
<br />the Lee Ferry obligl1tion because of the physical in.l1,bilityto .use the.'
<br />water, the place of N.ew Mexico uses, and the limitation of New
<br />MllXico's uses by its entitlement. .
