<br />1047 <br /> <br />Attachment A <br /> <br />12/3/76 <br /> <br />SUPPLEMENTAL MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE <br />SECRETARY OF THE INTERIOR <br />AND THE <br />SECRETARY OF THE ARMY <br />TO RECOGNIZE PARTICIPATION <br />BY THE UPPER MISSOURI RIVER BASIN STATES <br /> <br />This Memorandum of Understanding, entered into on this <br /> <br />day of <br /> <br />, 1976, amends and supplements the Memorandum of Understanding <br /> <br />between the Secretary of the Interior and the Secretary of the Army dated <br /> <br />February 24, 1975. A copy of that Memorandum of Understanding is attached <br /> <br />and its provisions remain in effect except as hereinafter modified. This <br /> <br />Supplemental Memorandum of Understanding explicitly reaffirms and strengthens <br /> <br />the water marketing program, which is predicated on the concept of states' <br /> <br />rights and the right of self-determina tion. This act i",n is taken with the <br /> <br />expressed intent of involving the states directly in critical water resource <br /> <br />development decisions that affect their states. <br /> <br />1. It is agreed that the date of termination of the February 24, 1975, <br /> <br />Memorandum of Understanding is hereby extended unti 1 the "ne million acre- <br /> <br />feet of water determined to be available for industrial w~ter marketing <br /> <br />pursuant to Sections I and 2 of the Memorandum of Und"rst~nding is committed <br /> <br />to such utilization. <br /> <br />2. The Department of the Interior and the Uepartme<ll of the I\.rmy <br /> <br />agree to cooperat~ fully with the Upper Basin States of Montana, Nebraska, <br /> <br />North Dakota, South Dakota, and Wyoming to morket the waters for industrial <br /> <br />use from the six main stem reservoirs made available pursu;mt to this <br /> <br />supplemental Memorandum of Understanding. <br /> <br />3. Pursuant to Item 1 of the attached Memorandum of Understanding, the <br /> <br />Secretary of the Interior has delermined the amounts of water that are <br /> <br />available from ~apacity provided in the six main stem reservoirs and the <br /> <br />probable extent of future irrigation development. <br />
